A public hearing having been had upon the above improvement upon due notice, and the Council
having heard all persons, objections and recommendations relative thereto, and having fully considered
the same; therefore, be it
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is to grade and surface with bituminous material a
portion of the alley in Block 9, Bohlandts Edgcumbe Hills from Quirnia Ave. approximately
80 feet north
and the Council hereby orders said improvement to be made.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and submit same to the Council for
approval; that upon said approval, the proper city officials are hereby authorized and directed to pro-
ceed with the making of said impxgk lef' `t ccordance therewith.

The undersigned owner of the property immediately adjoining
the proposed driveway under Preliminary Order No. 211956,
approved April 2, 1963, does hereby object to the proposed
alley on the following grounds:
1. That the same is not a public alley but is merely a drive-
way to the garage of the petitioner and soley for the benefit
of the petitioner,
2. That said petition is not in proper form as the same must
be signed by three or more interested property owners,
3. That the Council does not have the power to approve the
petition for such alley.
This petitioner respectfully requests that said petition be
denied.
