RES(I. W That for the purpose of effectuating the true intent and purpose
of the Council and to provide therefor and facilitate the acquisition under the
power of eminent domain by the City of St. Paul of land necessary to open, widen
and extend the proposed ,Arch - ,Pennsylvania Highway by condemning and taking cer-
tain parcels of land pursuant to the prior resolution of this Council in the
nature of Final Order C.F. No. 212303, approved April 23, 19633 that said prior
resolution, C.F. 212303, be and the same is hereby amended so as to provide for
the taking and condemning of the fee title to a portion of a certain parcel of-
land described therein and for the taking and condemning of a temporary easement
for construction purposes on the remainder of said parcel in the following par-
ticular, to -wits that the last description as contained in said final order in
the section defining the precise nature, extent, and kill of improvement to be
made by the said city be amended in the following particular, to wit: that
the resolution description contained therein reading as follows: "by condemning
and taking the following described lots and parcels of land, all in the City
of St. Paul * * * a triangular parcel of land being part of Ash Street vacated
and lying northerly of Pennsylvania..Avenue, measuring 60 feet on the northerly
line of Pennsylvania Avenue and 25 feet on the easterly line of Ash Street
vacated, both lines measured from the intersection of the aforesaid lineslt be
and the same is hereby amended so that the same shall read as follows: "by con-
demning and taking the following lots and parcels of land, all in the City of
St. Paul * * * a triangular parcel of land being part of Ash Street vacated
grid lying northerly of Pennsylvania Avenue, measuring 35 feet on the northerly
line of Pennsylvania Avenue and 12 feet on the easterly line of Ash Street va-
cated, both lines measured from the intersection of the aforesaid lines; also
a temporary construction easement to remain in effect for a period of two years,
commencing January 1, 1964, and expiring January 1, 1966, in the following: a
parcel of land being part of Ash Street (vacated) lying southeasterly of a line
drawn from a point on th& northerly line of Pennsylvania Avenue 60 feet westerly
from the easterly line of Ash Street (vacated) to a point on the easterly line
of Ash Street (vacated) 25 feet northerly from the northerly line of renn";ylvania
Avenue, as measured along the easterly line of ,Ash Street vacated, excepting there-
from that triangular parcel of land being part of Ash Street vacated and lying
northerly of Pennsylvania Avenue measuring 35 feet on the northerly line of
Pennsylvania Avenue and 12 feet on the easterly line of Ash Street vacated, both
lines measured from the intersection of the aforesaid lines;
