PAUL COUNCIL NO • OFFICE OF THE CITY CLERK FILE COUNCIL RESOLUTION - GENERAL FORM PRESENTED BY COMMISSIONE 2131LOiL RESOLVED, pursuant to the pertinent application therefor by Roster Pontiac, Inc., owner of the subject premises, that said Roster Pontiac, Inc., hereby is granted a permit for the enlargement and extension of its existing used car sales lot on the premises located at and adjacent to the southwest corner of East Seventh Street and Bates Avenue in the City of Saint Paul, particularly described as Lots 2 and 3, Zimmerman Place, so that the same shall conform to the approved plan therefor herewith filed, among other things incorporating a bumper high fence along abutting public street lines;-and that said: permittee and its successors and assigns, in respect of said premises, in the construction, maintenance, and operation of the subject enlarged and extended used car sales lot, shall make due compliance at all times with applicable City ordinances and State statutes and rules and regulations of public authorities having cognizance. O'Connell City Clerk Building - Dear Madam: This is in the matter of the application of Roster Pontiac Inc. for a permit to enlarge an existing used car sales lot on property located at the southwest corner of E. Seventh Street and Bates Avenue which is described as Lots 2 and 3, Zimmerman Place. The first 100 feet from E. Seventh Street is zoned commercial and the rear 56 feet is zoned 11B" residence and has been since 1922. However, this portion of the tract has been used as a legal non - conforming parking facility since 1922. On February 4, 1961, the Council granted a permit for a used car lot on a portion of the subject property subject to the condition that all lights on this lot be turned off not later than 10 P.M. The subject property has a frontage on the south side of E. Seventh Street of approximately 160 feet and on the west side of Bates Avenue of approxi- mately 156 feet resulting in an area of approximately 24,960'square feet. To the west, east and north are various commercial uses and to the south and adjoining is a multi - family residence which fronts on Bates Avenue. Field investigation discloses no basic objection to the expansion of this use. The plans meet the standards for this type of facility and have been approved by the Traffic Engineer. In consideration of the above factors, the Board of Zoning recommends the granting of the application for a permit to enlarge an existing used car sales lot on the above described property subject to a bumper - height fence along the street frontages and in accordance with plans approved April 25, 1963.
