WFIEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject
noise in the City of Saint Paul; and
4 WF�REAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 consritute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, the University of St. Thomas, represented by Charlie Potts and Amy Graff, Assistant
Directors of Campus Life, who have been designated as the responsible persons on the application, has
applied far a variance to present live music in the middle of the campus at 2115 Suinuiit Avenue; and
WHEREAS, applicant is seeking a variance for the hours of 7:00 pm. to 9:00 pm., on Saturday
May 12, 2007; and
WHEREAS, if applicant is not granted a variance it will not be able to present live music at 211 S
Summit Avenue; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the
applicarion and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the University
of Saint Thomas, subject to the following condirions:
1) The variance shall be for the hours of 7:00 p.m. to 9:00 p.m., on May 12, 2007.
2) All electronically powered equipment used in conjunction with the event shall not exceed 95
dBA, as measured at 50 feet from the source.
3) The speakers shall be directed away from nearby residences.

FURTHER RESOLVED, that any violations of the conditions set forth above on the May 12, 2007
date may resuit in denial of future requests for the grant of a noise variance, in addition to any criminal
citation which might issue.
