2 SE IT RESOLVED that, upon the petition of the Housing and Redevelopment Authority of the
3 City of Saint Paul, Minnesota, as documented in Public Works Technical Services, Vacation File
4 Number 01-2007, the public property hereinafter described, as follows and on attached map
5 Exhibit A, is hereby vacated of its interest as alley right-of-way:

The northwesterly 18 feet and the southwesterly 25 feet of lot 3, block 14,
Whitney and Smith's Addition to Saint Paul, Ramsey County, Minnesota as
described in the Talzing for Alley by the City of Saint Paul, recorded under
document numbers 1062994,165524 and 167245 together with any rights
accruing through usage by the Public or the City of Saint Paul that may
exist on lots 2 and 3, said plat of Whitney and Smith's Addition to Saint
Paul;
and be it further
RESOLVED that, subject to the herein stated exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntarily on behalf o£ District Energy/District Cooling St. Paul,
a private, non-profit Minnesota corporation; Saint Paul Regional Water Services, a
municipal corporation; Northern States Power Company dba Xcel Energ,y (Electric), a
Minnesota corporation; Qwest, a Colorado corporation; made a part hereof by this reference
and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the alley right-of-way and utility easements in
the area to be vacated, described above and subject to the following, including:
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
l. That the pefitioners, their successars and assigns shall pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolurion.
2. That the petitioner, their successors or assigns, will grant a public alley easement which
outlets onto Fifth Street East, to be located within the southwesterly twenty-eight feet of
lots 1, 2 and 3, block 14, Whitney and Smith's Addition to Saint Paul, substantially as
shown on E�ibit A, and subject to the requirements and satisfaction of the Department of

Public Works; and also on behalf of the Department of Public Works:
a. That a permanent utility easement shall be retained on, over, under and across the
vacated azea on behalf of the City of Saint Paul, Deparfinent of Public Works to
reserve the rigJ�t of the City to maintain and operate any sewer in or upon said
easement and to enter upon said easement or any portion thereof at any time and from
time to time, for the purposes of future construcfion, reconstruction, inspection,
maintenance, or repair of the same or, any part thereof. Said utility easement shail be
subj ect to the following conditions:
b. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects_which may prohibit normal access to utility facilities for
maintenance purposes will be permitted within the easement area.
c. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Depariment of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.
d. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, all removal,
replacement or modification costs sha11 be borne solely by the petitioner.

No change from the existing grade within the easement area shall be permitted
without written permission from the Department of Public Works Sewer Division.
No change in surfacing within the easement area shall be pernutted without.written
permission from tl�e Department of Public Works Sewer Division.
g. The pefitioner, its successors and assigns shall fully indemnify, defend, and save
hannless the City of Saint Paul, its officers, agents, employees, and servants from all
suits, actions, or claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe or connection in said reserved easement
arising out of or resulting from any action or negligence of the petirioner, its
employees, agents, or business invitees.
3. That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, far
existing facilities. The petitioner or its successor sha11 provide new easements if required
and the petitioner or its successor shall assume all costs of relocating facilities to the new
easements.
4. That the pefitioner, their successors and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers and employees from all suits, actions or clauns
of any character brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this

properiy, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
5. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shali, within the period specified in the terms and
condifions of this zesolution, comply in all respects with these terms and conditions.

Jean: I looked at the material you provided and then checked the block
bounded by Wall, Wacouta, 4th. and 5th. Your material spoke about an
alley that hopefuiiy will be vacated and a new alley created. Your
materiai had areas marked in blue, red and yeilow. I'm not sure what
the blue, red and yellow indicates. Therefore I'm not sure what is to
be vacated and what is to be created. In looking at the area, there
seems to be a large open area close to the center of the block with
buifdings around the perimeter. Access can be made from Wacouta (two
pfaces by foot since it appears botfi are too narrow for a car), from
4th. by going through a parking fot and from Wall by going through a
parking lot. The NE portion of the block appears to be under
construction. In any event, I do not see anything that would impact
the delivery of police services if any of those access points are
changed. Please call me if you have any questions. Thanks.

LfEP has the fiollowing comment on the proposed vacation at this time:
Per our phone conversation earlier today, it is my understanding that the property owner intends to
dedicate a new public alley going io 5th Street as a part of the proposed development of this site as a
Farmer's Market and condos. It may make sense to make dedication of the new alley a condition of the
vacation so we are not creating a dead end alley.
If the new alley is dedicated, LIEP has no objections to the proposed vacation. If you find that they are not
proposing to dedicate the new a�ley, please let me know so I can think about the proposed vacation some
more.

consider the petition of the Housing and Redevelopment Authority of the City of
Saint Paul, Minnesota.
This petirion is to vacate alley rights in the block bounded by East 4 and 5�' Streets
and Wacouta and Wa11 Streets.
The purpose of this vacation is to consolidate property for redevelopment. There is
building proposed within the vacated area, and a new alley will be dedicated along
with a future piat.
