WHEREAS, the Legislative Hearing Officer conducted a public heazing on the application for (ID # 20060003577)
Liquor On Sale — Over 200 seats, Liquor On Sale — Sunday, Entertainment B and Restaurant (C) -- Limited licenses for
Karen Selvig, president, Selvig Inc., doing business as Cabs Pub and Eatery at 492 Arcade Street on February 12, 2007
and continued it on March 22, 20Q7; and
WHEREAS, the I,egislative Heazing Officer heazd testimony and reviewed materials presented by the City's licensing
staff, the applicant and other interested parties; and
WHEREAS, as a result of this review, the following conditions were discussed and agreed to by the applicant which is
confirmed in a signed affidavit on file in the Office of License, Inspections and Environmental Protection (LIEP); and
The licensee will provide working video suroeillance cameras and recorders on the premises to provide
documentation of activities on all of the interior and exterior azeas of the establishment. This equipment must be
in operation during all business hours. Tapes must be maintained for thirty (30) days and must be immediately
available to the Saint Paul Police Department and the Office of License Inspections and Environmental
Protection, upon request. The surveillance system will have 12 (or more) cameras and must meet with the
approval of a designated representative of the Saint Paul Police Deparhnent with regard to the type, placement
and direction of the cameras, in order to assure adequate observation of the premises. The deadline for the
surveillance cameras and recorders to be installed and operational is April 19, 2007.
2. The licensee must maintain a list of customers banned from the establishment for assaultive, disorderly, or
disruptive behavior. This list will contain the name and description of the banned person, as well as the date that
he/she was banned. This list must be immediately available to the Saint Paul Police and LIEP upon request.
SecuriTy personnel shall be assigned to each entrance starting at 9:00 p.m. and shall remain until all patrons have
left the Iicensed premises. Security personnel shall "wand" (using a metal detector) each patron and check all
handbags and packages carried by patrons. The requirement to "wand" patrons inciudes those who are returning
to the bar from the patio. SecuriTy personnel shall employ the use of electronic card readers at each entrance
(including the patio entrance) starting at 9:00 p.m. Security personnel shall verify the age of patrons by checking
state or federally issued identification cards (no picture I.D., no entrance). Customers re-entering the establish-
ment shall be subject to the same security measures as customers entering the establishment for the first time.
4. Security personnel will monitor the pazking to ensure that patrons are not parking on the boulevards and
sidewalks and posted handicap pazking areas.
5. All smokers shall be monitored by the security personnel to insure that there is no excessive noise outside of the
establishment.
6. The license holder, security staff, and employees of the establishment shall cooperate with the police by calling
for assistance when there is a threat of violence or other criminal behavior inside or outside the establishment.
License holder will ensure that only employees of the establishment are allowed in the basement. Basement is to
be used as storage and office space only.
8. License holder will secure the pool cues and equipment.
9. License holder will make sure that all refuse, trash and equipment used for providing entertainment is removed

from the premises during the daytime hours. Bottles and other trash aze to be placed on the patio immediately
next to the back door at closing time and put into the dumpster the next morning. Under no circumstances will
bottle dumping be allowed to occur after 9:00 p.m. At least once each day, the licensee will pick up and dispose
of all trash on the licensed premises, including the parking lots and adjacent streets.
License holder will permanently locate its trash dumpsters at least six (6) feet away from the east end of its patio
by Mazch 16, 2007. It will not be permitted for the ]icense holder to move the dumpsters to its parking lot across
Jenks Avenue.
Licensee must be in compliance with all conditions prior to the issuance of the license and must remain in
compliance at all times.
All patrons must be off the patio by 10:00 p.m. Security personnel will ensure that patrons do not climb over the
fence which surrounds the patio.
Alcohol Awazeness Training shall be required each year for all empioyees.
AND WI�EREAS, the Legislative Hearing Officer concluded t6at it is very likely that at least some of the license
conditions under which the applicant was operating were not adhered to under the previous management of Linda
Anderson or current management of Kuen Selvig which findings are outlined in the attached report of April 9, 2007; and
WHEREAS, the Legislative Hearing Officer notes that this finding must be made through an adverse action process; and
WHEREAS, the Legislative Hearing Officer recommends that this license application be referred by the City Council to
the City Attorney's Office for adverse action regarding the issuance of the license as described in Chapter 310 of the Saint
Paul Legislative Code; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul adopts the recommendation of the Legislative Hearing Officer and
hereby refers this license application to the City Attorney for adverse action.

In recent weeks I have conducted two hearings on the license application of Kazen Selvig for Cabs
Pub and Eatery at 992 Arcade Street. She has applied for the following licenses: Liquor On Sale —
Over 200 seats, Liquor On Sale — Sunday, Entertainment (B) and Restaurant (C) — Limited licenses.
This application is based on a change in ownership of the business from Linda Anderson to Kazen
Selvig. Kevin Anderson has continued to be the building owner throughout. Ms. Selvig has been an
employee of the business for nearly 11 years, lives on site in an apartment above the bar and has
managed the establishment for some time.
Concunently with the legislative hearing process, licensing staff and police have been meeting with
the applicant and building owner to discuss recent concerns and license conditions to address those
concems. As a result of these discussions, the license conditions in the community notification (on
the license application) were expanded upon and the new conditions were put in fhe record aY the first
legislative hearing. During the course of the first legislative hearing additiona] changes to the
conditions were discussed and agreed upon. The matter was continued for five weeks to determine
whether the conditions were being adhered to and if further modi6cation required.
The concerns outlined in the letters requesting a legislative hearing described a situation where botb
the establishmenYs management and patron behavior was of concern to the neighbors. Of particular
concem were the following behaviors they testified were problematic:
• patron noise in the area, especially at closing time;
• patron noise &om the patio azea, especially later at night;
• patron litter, lazgely from customers leaving trash and empty bottles in the areas where they
parked their cars;
• patron violence and threat of violence intimated by loud and angry voices, especially at
closing time;
• patron 1Qitering, especially at closing rime where in addition to noise and the threat of
violence, the loitering presents as vehicle congestion in and around the bar area; and
� patron behavior coming and going from the establishment including fencejumping, p�blic
urination and possible property damage.
When neighbors and neighborhood organizations describe problems associated with a business
seeking a Class N license, the first option we use in the legislaYive hearing process is to consider
license conditions which will allow the business to operate, but alleviate the concerns of those who
report being adversely affected by the operation of the business. Cabs had been operating with a list

of conditions at the time Ms. Selvig made application to be licensed. It is standard practice for these
conditions to carry over to the next licensee unless there has been a substantial change in the nature of
the proposed business which is not the case. As mentioned, there were also additional conditions that
had been vo]untarily added recently as a result of discussions with iicensing staff and police. It is my
practice to look at a business's performance in complying with existing license conditions to assess
how they will perform on newly deveioped conditions. Given the consistency in the management
team for Cabs from the old license to the new license application, this approach seems particularly
appropriate.
Although Cabs does appear to be in compliance with many, if not most, ofthe conditions on the
license, there are some notable exceptions. First, there is the requirement that there be video
surveillance cameras for inside and outside the business. This condition had been modified in the
discussion with licensing staff and police prior to the first legislative hearing on Februaty 12, 2007. It
was further modified in the first hearing to read as follows:
The licensee will provide working video surveillance cameras and recorders on the premises
to provide documentation of activities on all of the interior and exterior areas of the
establishment. This equipment must be in operation during all business hours. Tapes must
be maintained for thirty (30) days and must be immediately available to the Saint Paul Police
Department and The O�ce of License Inspections and Environmental Protection upon
request. The license holder shall work with the Saint Paul Police Department to make
sure that the security cameras are properly aimed and placed to provide surveillance of
the premises. The deadGne for the surveillance cameras and recorders to be installed
and operational is March 16, 200Z [Bold text added in legislative hearing.]
At the March 22, 2007 Legislative Hearing the applicant indicated the cameras had not been installed.
Ms, Selvig and Mr. Anderson also said the meeting between Cab's contractor far the cameras with
the appropriate police staffhad taken place the previous day, March 21, 2007. I believe this situation
is problematic on two levels. First, it is clear that the applicant did not take seriously the condition or
the timeline, which is indicative of a poorly run licensed establishment. Second, this casual approach
to license conditions significantly diminishes the likelihood addirional or modified license conditions
to alleviate neighborhood concerns will meet with success.
A second condition that appears not to have been met is the following

available to the Saint Paut Police and LIEP upon request.
In the second legislative hearing on March 22, 2007, iicensing staff indicated Ms. Selvig had agreed
two days earlier to bring in this list to this heari�g. It was not forthcoming at the hearing where Ms.
Selvig made statements which indicated she was unaware this was a condition of the license for
which she was applying. As of April 5, 2007 this list has not been provided to staff. As Ms. Selvig
understood the direction to produce a list of employees at the hearing and this was done, it seems
entirely possible that there is no list of persons banned from the establishment. This lack of
compliance with condition #2 presents the same problems as does the lack of compliance with
condition #1.
Third, it was not until the March 20, 2007 meeting with licensing staffthat the applicant took
seriously and came into compliance with fhe following condition:

Finally, I noted and was disturbed by the apparent disassociation the management of Cabs seems to
have in reference to behavior on the outside of the bar, up to and including comments that they did
not want their staff going outside the building because of the unsafe conditions. These conditions are
]ikely either created by or exacerbated by the presence of this licensed establishment. Addressing
these problems wil] by definition involve the meaningfu] participation of Cabs.
In the legislative hearing process information was gathered and reviewed from a number of sources,
including: 1) the afore-mentioned letters from neighbors; 2) testimony from neighbors, city staff and
the applicant; and 3) review of other documents. The goal of the legislative hearing process is to
come to a conclusion as to whether a matter should be referred for a hearing before and independent
hearing examiner in accordance with the procedures set forth in section 310.05. The establishment of
license conditions often makes unnecessary the referral of cases to such an examiner as neighborhood
concems can be handled at this lower level. However, that process is predicated on the license
app(icant's ability and intention to operate in compliance with the license conditions. In the case of
Cabs I believe there is a relarively low likeiihood for the success of license condirions based on the
City's past experience with this management team. Therefore, I recommend that the City Council
refer this matter to the City Attorney's Office for adverse action.

The hearing was called to order at 10:04 a.m.
Staff Present: Reid Soley and Kristina Schweinler, License, Inspections and Environmental
Protection (LIEP); and Jean Birkholz, Council Research.
Others Present: Karen Selvig, business owner, Selvig Inc; Kevin Anderson, property owner;
Roger and Marian Layer, neighbors; Stewart and Doreen Krenik, neighbors

(B) and Restaurant (C) — Limited licenses
Ms. Moermond stated that this license application is for Class N Licenses which require neighborhood
notification. Other examples of Ciass N Licenses include auto repair, auto sales, auto body, tarioo
parlars, etc., things that have an immediate impact on the neighbors. The City received one letter and
one email of objection to the issuance of this license which means that a Legislative Hearing is
necessary. There are three (3) possible outcomes of this heazing. Ms. Moermond could: 1) recommend
to the City Council that they grant this license without any conditions; 2) recommend to the City
Council that they grant this license with agreed upon conditions; or 3) recommend to the CiTy Councii
that they refer this matter to an Administrative Law Judge, which usually takes from four (4) to six (6)
months. Ms. Moermond would use this option if she thinks that there's no way that this business is
workable at this location or if she thinks that there are conditions that are absolutely necessary to make it
workable that the applicants find unacceptable. Ms. Moermond's recommendation will come to the City
Council as a resolution and it wiil appear on the Consent Agenda.
Ms. Moermond will begin with a staff report. Next, the business proposal will be discussed. People
with concerns about the license will be heard as well as people who aze here to support the license.
Mr. Reid Soley, License, Inspections and Environmental Protection (LIEP), reported that there are
twelve (12) condit3ons that LIEP is proposing:
1. The licensee will provide working video surveillance cameras and recorders on the premises to
provide documentation of activities on the interior and exterior of the establishxnent. This equipment
must be in operation during all business hours. Tapes must be maintained for thirty (30) days and must

10. License holder will either move its garbage storage facility to its parking lot across Jenks Street
(which requires prior written LIEP Zoning approval) or move it away from the lot line with the
adjoining residential property by January 1, 2007.

12. All patrons must be off the patio by 1 Q PM.
The cunent licensee is Cab's Pub and Eatery Ina There is no recommendation frozn the neighborhood
organization. There are no building issues. Environmental Health has approved this application;
however, there is a plan review fee of $87.50 that needs to be paid. Fire and Zoning has approved it.
Licensing has approved it with conditions. LIEP recommends this license be approved with the
conditions listed above.
Ms. Moermond asked Ms. Selvig whether she had any questions about the conditions. Ms. Selvig
responded that regarding conditions #12, they have erected a big fence that keeps patrons contained to
one area. If the patio is locked up at 10 p.m. and patrons are put out in front, they will be up and down
the boulevard. She can keep an eye on them on the patio, but not up and down the boulevard.
Ms. Selvig is buying the business and leasing the space. She stated that she has been working at this bar
for nearly eleven (11) yeazs. Mr. Kevin Anderson's former wife, Linda Anderson, was the previous
license holder. Ms. Selvig stated that only Minnesota and Wisconsin IDs are accepted at the bar. She
enforces a dress code and employs anned guards and bouncers at the doors. They are tying to weed out
the unwanted patrons. It's been a pretty quiet place for the past two (2) months. She has been a waitress
and bartender in Cabs and has managed Rainbow Foods on Arcade (11 years ago) and an Amoco Station

(15 years ago) on Wlute Bear Avenue and at Cabs, the last three (3) and four (4) years. Managing duties
at Cabs have inciuded: accounting, hiring, firing, etc. Hours: closed on Mondays; Tuesday tY�rough
Friday, noon — i a.m.; Saturday and Sunday, 10 a.m. —1 a.m. She tries to get people out fifteen (15)
minutes before closing. Pizza, subs and wings aze on the menu. "I'he place holds ten (10) pool tables
and approximately 200 seats.
Ms. Moermond asked Ms. Schweinler, LIEP, if she had anything to add to the staff report. Ms.
Schweinler added that some of the conditions aze carry-over from the previous license holder; some are
additional. The patio closing at 10 p.m. is new; the security camera requirement has been re-worded;
securing pool cues is new; and the basement use is new. Ms. Moermond asked what sort of
circumstances led to these new conditions. Ms. Schweinler responded that these conditions were
developed during a meeting with the licensee and a representative from the Saint Paul Police
Department, Commander McNamara. Some were in response to letters/phone cails of complaint that
were received. Some were put on as zoning conditions, a result of the site plan review.
Ms. Moermond asked whether the parking lot across the street was leased or owned by Mr. Anderson.
Mr. Anderson replied that he owned it.
Mary and Roger Layer spoke in opposition; they live next door. Mr. Layez started out by saying that he
was not anti-baz; however, he has many concerns that are legitimate and Cabs has not been responsive to
them. They have called about the noise issues. Before the smoking ban, Ms. Selvig would be very
polite when they called about the loud music and she would close the doors. After the smoking ban,
things went down hill. Mrs. Layer would call only to be hung-up on or Ms. Selvig would ignore her
concerns. Since August, there have been at least six (6) shootings. If only the people could be
contained by 10 pm. Perhaps people are being kicked out of the bar or something, but they aze coming
up the boulevard, hopping over the Layer's fence into the patio and going back into the bar. She
wonders whether some of these peaple are under age and getting into the bar by hopping over their
fence. She had been sick and needed to go into emergency in August. When she got down there, she
had to wait because they had just bxought in a patient who had just been shot at Cabs; he was nineteen
(19) yeazs old. Why was he in Cabs? There are a lot of little kids in the neighborhood that she is
concerned for because of the rowdiness of Cabs' patrons. She has lived on that block for almost 65
years and iYs never been as bad as it is right now. Mr. Layer added that on a given Saturday night when
they do sit out on their porch, there's probably a half dozen people who go over that fence. Maybe
they've been banned or they're too young or they have a pistol in their pocket. The bar should be aware
of that. He wonders if people get wanded after they come off the patio. Mr. Layer stated that he takes
issue with Ms. Selvig saying there have been no incidents at the bar because there have been close to a
dozen shootings within the last two (2) years. There was a shooting as recent as January 23, 2007.
Since August 5, 2006, there have been three (3) shootings within a two (2) week period. There's a fig�t
out there almost every other night, if not every night. He asked whether the surveiilance cameras will
have sound. Mr. Anderson replied that they will. Mrs. Layer works during the day. She gets up a 430
a.m. and people are out on the patio until nearly 1 am. or later, so iYs nearly impossible for her to get to
sleep. If she does get to sleep, then the trash truck comes at 3 or 4 a.m. and wakes her up again,
although she hasn't heard this for a while. At closing time on Tuesday, Thursday and Sunday, the noise
is really bad and there's a total traffic jam. The cars block each other in and no one will move. Patrons
park on the boulevard and on ihe sidewalk; some even drive down the sidewalk. These people urinate
anywhere; they park, get out of their cars and urinate before they go into the baz. All this bad behavior
seems to create an environment where people think they can do anything they want around the
neighborhood. Mr. Layer believes that if the azea is not policed, iYs going to get worse. Mr. Layer is
afraid that it won't be long before there's a murder. He talked with a police man one day about the

situation there and said, "You know, iYs not going to be long before this is one of the worst corners in
Saint Paul," and he said, "You know what? It already is."
Other concerns include beer bottles lying in the parking azea, on the boulevazd and on the sidewalk.
These bottles aze not picked up the next moming when Cleveland Junior High students walk to school.
These kids pick up the bottles, throw them in the air and let them smash in the street. Another thing that
has bothered Mrs. Layer was that although, she has tried not to complain, she has heard Ms. Selvig
talking to other people about the "bitch" ihat lives next door. She thinks that is wrong; she has lived
there over 50 years and there has never been anything like this. Ms. Layer has stopped being a licensed
day caz because she is afraid of whaYs going to happen out there since the clientele has changed so
tremendousiy, and there's no cooperation from either Mr. Anderson or Ms. Selvig. The last
conversation Mr. Layer had with Mr. Anderson, Mr. Anderson told Mr. Layer that he was just being
argumentative; that none of what he was concerned about was legitimate.
Doreen and Stewart Krenik spoke in opposition; they are neighbors who live across the street from the
Layers. Mrs. Krenik explained that they are parents of five (5) children and these conditions make it
very difficult to keep them safe. At night, Mrs. Krenik makes sure her children do not use the computer
because she is afraid that a stray bullet may come through the living room window. They shouldn't
have to live like that. The Kreniks voiced the same cancerns: obnoxious noise, urination, the violence,
the shootings, groups of people hanging out after closing, eta Their children cannot play outside. They
are very frustrated. Mr. Krenik added that the trash container is not in the parking lot; iYs the patio area.
They have called the bax when they have seen things going on; most of the time, the phone just rings or
they just hang-up. When things get really loud from people on the patio, for instance, they call the
police, but by the time the police arrive, the people have dispersed and there's no noise. At closing time,
the longer the groups hang-out, the more times there's a violent happening. The smoking area and
closing time bring the most noise and chaos. Mrs. Krenik thinks that it would help if at closing time,
people exited on the Arcade Street side.
Ms. Moermond stated that both of these families have lived on the block for a very long time. She asked
them what has changed over the years to make it so bad now. Mr. and Mrs. Krenik responded that the
patrons of the bar are a completely different group. Mrs. Krenik thinks that Scott's Bar's patrons have
moved to Cabs. Scott's was shut down because of shootings, etc. Things have drastically changed.
Mr. Krenik stated that a couple of times he's gone outside after closing and found ail his tires slashed.
Mrs. Krenik added that Mr. Krenik and she are both handicapped and someone had parked in their spot.
They drove around on several occasions until someone moved so that they could find a parking spot.
The people who had parked in their spot ended up with a ticket and a week later their tires were slashed.
There have been many cars towed from that spot and they are concerned about more retaliation.
Ms. Moermond called for a 10 minute break so that she could review the police phone logs.
When the hearing was reconvened, Ms. Moermond asked for comments from the applicants. Mr.
Anderson stated that he has owned this building for approximately I S years and has worked with Ms.
Rozek. He has also had conflicts with the neighbors. One of the major things contributing to the bar's
problems with the neighborhood came about because of the smoking ban. He built a new eight foot
fence, but perhaps he'll need to get a variance to build a higher fence. The bar makes sure they hand-
wand people coming into the baz from both the front and the patio. The neighborhood has changed into
a very multi-cultural neighborhood. Because of all the incidents, and especially because of what
happened at Eric's a couple of years ago, they were the first place to put an armed guard into a bar.
They are concerned for their staff, especially at closing. They realiy don't want their employees to go

outside. There has never been an incident inside the baz. They had a drive-by shootang outside the baz.
Working with police, it was discovered that the Twin Cities seems to be attracting more and more gangs
from Illinois, so limiting peopie coming into the baz with only Minnesota or Wisconsin IDs seemed to
be a good idea. Most of the bar's patrons aze good and respectable people and only surveillance
cameras on the outside will be able to pick up who the trouble makers aze. Mr. Anderson doesn't
believe that there have been a dozen shootings; he knows there's been a drive-by shooting. There are a
lot of things that happen at the baz; a lot of them aze in conjunction with the patio.
Ms. Moermond asked where the gazbage was collected. Ms. Selvig responded, "The patio." Ms.
Moermond asked if that is where it is supposed to be, according to Zoning. Ms. Schweinler responded
that according to Zoning, it is supposed to be located across the street in the parking ]ot. Mr. Anderson
responded that he remembers someone from Zoning giving them the option to either move it from the
property line or move it across the street. The person from Zoning told him that he wasn't sure that the
garbage could go across the street. At night, the garbage is put near the back door and it is dumped
during the day. Dump trucks always come during the day; no dump trucks come at 2 a.m. Mr. Selvig
added that nothing is dumped after 10 p.m. Ms. Moermond noted that there had been a lot of
commentary about borile, beer bottles and beer cans associated with the bar, but these are not coming
from the bar, according to the applicants, but coming in patrons' cars. Ms. Moermond asked about the
outside cameras. Mr. Anderson responded that right now, there is only one (1) outside camera; iYs on
the patio. In the future, there will be four (4). The order was placed two (2) weeks ago; hopefully, they
will be installed within the next thirty (30) days. Two (2) cameras will be placed up and down the
building on the outside and one (1) will be duected across the street at the parking lot. There will also be
signage indicating that the area is being monitored with surveillance cameras. Ms. Moermond stated
that she wants a time certain and also wants 100 percent coverage of the bar property. Ms. Moermond
added that the bar's owners are responsible for the parking lot. Trash pick-up around the bar azea needs
to happen at least once a day. Bottle dumping may not occur after 9 p.m. Ms. Moermond wants a
definitive review from Zoning regarding where the gazbage should be.
Ms. Moermond noted that she has seen clientele changes among other bars in Saint Paul. Clientele are
no longer traditional or local, but at some bars, including this one, clientele is coming from the whole
metropolitan area. Although the gang issue did not come up in the letters, it is certainly present at Cabs.
Mr. Anderson commented that the bar has enacted a dress code, which seems to heip.
Ms. Moermond asked about closing time. Ms. Selvig responded that everyone's out at 12:45 a.m. Most
people leave; some stick around outside and talk loudly. Ms. Selvig tries to move them on and has
asked them to leave, but some do not. The armed guard does go out to help get them moving. When
they don't leave, Ms. Selvig calls the police. As soon as the people see the cops coming, they scatter.
Ms. Moermond noted that a condition will state that all surveillance cameras, 3nside and out, need to be
in place and operational by March 16, 2007. She added that people need to be stopped from going over
the fence. Perhaps they need to wand people after they come in from smoking or maybe they need to
install a special emezgency exit door.
Ms. Moermond asked the applicants to provide the neighbors with Ms. Selvig's cell phone number so
they can call to alert the baz when they see problems occur. This will help to rebuiid a neighborhood
relationship.
Ms. Moerxnond commented that she thinks it's fantastic that the applicant and property owner are
working with the police and it will be a great help when the surveillance cameras are installed.

Ms. Moermond asked if it could arranged that patrons leave by the Arcade Street door only. Ms. Selvig
responded that iYs set up that way now. Everyone goes out the Arcade door at closing time.
Ms. Moermond recommended that this hearing be continued sometime during the week of March 19,
2007. At that time, a review will be taken of the past thirty (30) days.
In the interim, conditions will be drawn up and an affidavit will be signed.
The next hearing was set for 10 a.m. Thursday, Mazch 22, 2007.

disorderly or disnxptive behavior. This list will contain the name and description of the banned person

Ms. Moermond stated that this is a continuation hearing from February 12, 2007. At the end of the last
hearing, we wanted to see how things were going to go and we were also waiting for the cameras to get
installed. Conditions were added at the last hearing, thinking that things would 6e taken care of in that
regard, too. The foilowing things were expected:
- surveillance cameras and recorders would be installed and operational by March 16, 2007.
- - a list of banned customers with name and description of the banned person and the date that
he(she was banned is to be maintained and immediately available to the Saint Paul Police
Department and LIEP upon request.
- pool cues and equipment were to be secured.
- the trash dumpsters were to be placed at least six (6) feet away from the east end of its patio by
March 16, 2007.
Moermond will hear the staff report from License, Inspection and Environmental Protection (LIEP) and
then hear from the applicant
Mr. Reid Soley, (LIEP), read through the license conditions as agreed upon at the February 12, 2007
hearing.
1. The licensee will provide working video surveillance cameras and recorders on the premises to
provide documentation of activities on all of the interior and exterior azeas of the establishment. This
equipment must be in operation during all business hours. Tapes must be maintained for thirty (30) days
and must be immediately available to the Saint Pau1 Police Department and the Office of License
Inspections and Environmental Protection upon request. The license holder shall work with the Saint
Paul Police Department to make sure that the security cameras are properly aimed and placed to provide
surveillance of the premises. The deadline far the surveillance cameras and recorders to be installed and

Ms. Moermond asked the applicant if the cameras were up and operational. Mr. Anderson replied that
LC Security Company ordered them two (2) weeks ago. The representative from that company met with
the Saint Paul Police Department yesterday to discuss where the Police would want the cameras
instalied. Mr. Anderson added that the meeting was very beneficial because Police want the cameras
placed in different places than they had intended to put them. Ms. Moermond stated that condition # 1
will need to be modified.

list. Mr. Soley added that a meeting took place two (2) days ago, Mazch 20, 2007, in LIEP's office with
Kazen Selvig; Christine Rozek and Kristina Schweinler, LTEP; Sr. Commander Bili Martinez, Police
Department; Rachel Gunderson, Ciry Attorney's office; and Mr. Soley. Ms. Selvig added that she hasn't
kicked-out anyone in months. She also said that she is not able to memorize every person's name who
comes through the door. The card scanner would make it easier to document the bans. Mr. Soley
continued to say that out of that meeting came an agreement that Ms. Selvig furnish three (3) things
today: 1) a list of banned customers, including names, descriptions and the dates they were banned. Ms.
Selvig stated that she was unaware earlier that she needed to document the bans. She did ask Secure
Force to fas the previously banned persons to LIEP today. She was unable to provide a list today. Mr.
Soley commented that he thinks Ms. Selvig should obtain that list from Secure Force and get it to him
herself, either by delivery or fax (651-266-9040). It was due today and needs to be done ASAP. Ms.
Moermond stated that she would like a copy of that list far the legislative hearing file.
Mr. Soley stated that another thing Ms. Selvig was supposed to bring today was the list of employees
and the other thing has to do with the Steve Pazsons' review. Ms. Seivig submitted the list of
employees. Mr. Soley will copy it and provide a copy for Ms. Moermond's file.
Ms. Moermond reviewed the police calis and asked if the people who are listed on police reports for
discharging weapons, aggravated assaults, fights, etc., are on their banned list Mr. Anderson responded
that he does not think there has been a discharge of a fireazm on their property, inside or out. If
anything, it happened out on the street or on the corner. Mr. Soley added that the meeting that took
place two (2) days ago in LTEP's office was prompted by a Saint Paul Police Department Incident
Report that was written on Mazch 5, 2007, at 12:07 a.m. The primary reporting officer was Michael
Denaski; the secondazy reporting officer was Joseph Reginec from the Eastern District. The narrative
reads:
Squad #398, Denaski and Reginec conducted a PPV (Proactive Visit) at Cabs Bar on 3-5-07 at
seven (7) minutes after midnight. We are the assigned Payne-Arcade beat car and haue been
doing numerous PPVs at the above location due to the increase in crimes of violence at the bar,
i.e., aggravated assaults, fights, obstruction of legal processes, etc. We conducted a PPV at 0007
hours at 3-OS-07. We were told that the ownership of the bar was going to try to keep gang
members out of the bar and do away with rap music since most problems occurred on certain
nights when rap music was played. We entered the bar and noticed the rap music was playing
again. I talked with the bouncer and he indicated that they re-instated it on certain nights, but it
was "light rap" not "hazd gangster rap." I did a short trip around the bar and noticed patrons who
are gang members ar associates of gang members: Andrew Bernard Glover of the Lower town
Gangsters, dob 4-10-84; also Michael Anthony Bargas, dob 1-21-83; and Jerome Douglas Bates,
dob 10-18-81. Other patrons who frequent the bar and are known gang members are Mario
DuRail Bogan, dob 1-14-70; Charles Eugene Fry, dob 11-08-79, cturently in custody for Diva's
Bar homicide; and Gilbert Allen, dob 8-23-82, cunently in custody for a drive-by shooting in
Washington County. Both Fry and Allen aze Gangster Disciples and many others. We pointed

out known gang members to bar staff on several occasions. Staff will continue to allow them to
patronize the baz.
As a result of this report, LIEP called in Karen Selvig to meet with staff and discussed what steps she
would be willing ta take to hy to deal with this matter of troublemakers being allowed to frequent the
baz. Mr. Anderson stated that the baz wouid be happy to have the list that police report provided
because they don't know who these people aze. Now, that they know some of them, they will not be
allowed in the bar anymore. Ms. Selvig said that she never told police that they would continue to allow
these people to patronize the baz. Mr. Soley thought that perhaps, that was the officer's impression. Mr.
Anderson stated that he and his staff do not know who the gang members are. It would be helpful if the
police would provide iheir staff with a list of these people so that they could put them on the banned list.
They don't want gang members in their establishment.
Ms. Moermond asked the applicants if they were satisfied with Officer Pazsons' recommendations
regarding the number and placement of cameras. The applicants replied that they were. Mr. Soley
noted that he spoke with Christine Rozek who said she had a conversation with Steve Parsons, and he
stated that he was at Cabs yesterday reviewing the security camera system, and he would like it to be
required to have eight (8) additional cameras be installed for a total of twelve (12). Mr. Anderson added
that he respects Mr. Pazson's recommendations; however, he made mention that he didn't want the
cameras to be over the tills. Mr. Anderson noted that Ms. Selvig needs to watch out for theft and the
inside staff needs to be safe. He thinks they need additional cameras to monitor their staff, Ms.
Moermond stated that she is fine with additional cameras.
Ms. Moermond said that she would like to ha�e the condition establish that these twelve (12) cameras
recommended by police be installed within four (4) weeks from today (April 19, 200�). The additional
cameras may be installed at the applicant's discretion.

last hearing. Mr. Soley replied that LIEP wants to modify this condition to include an identification card
reader be required to be used at each entrance where patrons are admitted. Ms. Moermond asked if
LIEP is requiring this for all hours of business or only during the limited hours in which the security
personnel are present. Mr. Soley responded that is still unclear. Mr. Soley noted that there seemed to be
a concern at the last hearing that people were jumping the fence and getting into the bar. Mr. Anderson
replied that if you come from the patio, you have to go past the security guard, so, you get re-checked.
Mr. Soley said that the idea with the card reader is that reader requires the card to be swiped; there aze
some readers that retain that information, although he doesn't think that it was Ms. Rozek's intent that
such type a reader be required, just that the patrons name and age comes up in big, block letters. Ms.
Moermond stated that the cazd reader condition would be added to condition #3.

Ms. Selvig noted that a11 employees wear bright yellow sturts to distinguish employees from patrons.
Anyone not wearing a bright yellow shirt is prohibited from tt�e basement.
8. License holder will secure the poo] cues and equipment.
Mr. Soley stated that there had been occunences in the past with pool cues being used in fights, so, it is
important to LIEP that all pool cues are secured. Two days ago, Ms. Selvig stated that nothing had been
done so faz regarding securing the pool cues. Ms. Selvig noted that they will be put behind the bar
starting today and patrons will sign in and out on a log sheet. Mr. Anderson questioned that condition.
He stated that he has been there for ten (10) years and doesn't recall one (1) incident with a pool stick
during that time. Mr. Soley said that he recalls reading a police report of an incident where an officer
tried to take someone out and the customer didn't want to go. There was kind of a wrestling match with
the police officer; there had been a fight or sozne type of threat, perhaps, made by that patron against
another patron and a pool cue was part of it.
9. License holder will make sure that a11 refuse, trash and equipment used for providing entertainment is
removed from the premises during the daytime hours. Bottles and other trash are to be placed on the
patio immediately next to the back door at closing time and put into the dumpster the next morning.
Under no circumstances will bottle dumping be allowed to occur after 9:00 p.m. At least once each day,
the licensee will pick up and dispose of all trash on the licensed premises, inciuding the parking lots and
adjacent streets.
Mr. Soley reported that he called Ms. Selvig on March 6, 2007 and asked her who their trash hauler is.
Ms. Selvig informed him that it was BFI. IvI�. So1ey then furnished that information to another inspector
(Rich Jenson) who deals with trash hauling complaints. One of the neighbors had complained that the
trash haulers sometimes come very early ln the morning (3:00 or 4:00 a.m.). There are specific hours in
Saint Paul when that is allowed. Mr. Jenson did call BFI to discuss that with them and told them that the
ailowable hours must be adhered to. They cannot pick up at Cabs eazlier than 7:00 a.m.
10. License holder wi11 permanently locate its trash dumpsters at least six (6) feet away from the east
end of its patio by March 16, 2007. It will not be permitted for the license holder to move the dumpsters
to its parking lot across Jenks Avenue.
Ms. Moermond stated that at the last heazing, it looked as though the site plan said that Cabs' gazbage
should be in the parking lot on Jenks Avenue and now, it looks as though it shouldn't be. Ms.

Moermond asked if a location had been selected. Mr. Soley asked if the dumpsters had been moved six
(6) feet from the fence line. Mr. Anderson replied that they will probably eliminate one (1) dumpster
and move the other one. He talked with someone who said that they will probably be able to get a
variance on the height of the fence to twelve (12) feet, and if need be, they will put another wall across
the dumpster area to pmtect from noise. Mr. Anderson also thinks that it should be required that the
trash is not picked-up unti19:00 a.m.
11. Licensee must be in compliance with all conditions prior to the issuance of the license and must
remain in compliance at all times.
Ms. Moermond commented that #11 seems self-evident but it hasn't happened yet.
12. All patrons must be off the patio by 10:00 p.m. Security personnel will ensure that patrons do not
climb over the fence which surrounds the patio.
Mr. Selvig stated that the doors on the patio aze locked at 10:00 p.m.
Additional conditions agreed upon by LIEP and the license applicant at a Mazch 20, 2007 meeting
(present at the meeting were: Karen Selvig, Christine Rozek, Kris Schweinler, Senior Commander Bill
Martinez, Rachel Gunderson and Reid Soley. The purpose of the meeting was to discuss a recent police
incident report concerning the presence of gang members at Cabs Pub):
13. The license holdeL, security staff and employees of tl�e establishment shall cooperate with the police
by calling for assistance when thete is a tkueat of violence or other criminal behavior,
14. Yearly alcohol awareness training shall be required far all employees (already required by the state).

Ms. Moermond asked Ms. Selvig and Mr. Anderson if they were comfortable with the changes talked
about so far. They responded that they had no problem with the changes. Ms. Moermond stated that
staff will re-draft these conditions and a signed affidavit will be required. Ms. Moermond will decide
this case later today or tomorrow. Ms. Selvig and Mr. Anderson will be informed via phone call and
letter.

I live across the street from Cab's Pub & Eatery's patio. I have heard & seen way too much problems. I
have 5 kids I am trying to raise. Since "Cabs ba ' -ved-+n i#fias been easy. Here are�ome of my
complaints: 1.) There have been at lea , in s since Auqust 200 . 2.) The nois�atAigfifon the
patio gets very loud at times. They se� s_mokers ou�t re. I can hear them fighting in my bed at night. 1
do beiieve they have a"police scanner" because w�ien I have called the police for the noise they come
outside and teiLe_ve�one to in. My kids have been woken up several times too. 3.) i have probabfy
picked up 0 to_60 bee� bottles __ ' e broken) off my property in the last six months. Not to mention beer
cans, alcahol 6o n� occasion a used condom. 4.) There has been many times the patrons
leave the bar a urinate in s ne's yard or in the street. On a couple occasions my kids were outside
around 7pm and the ar patron would stand by their ca
r and urinate in front o4 them. 5.) I do know it is costing the taxpayers of St.Paul fots of money for all of
the times the police have been called to Cabs Pub & Eatery.
All 5 of these items have progressiveiy gotten worse. Do I have to wait till one of my kids to get shot?
How in the hell do you raise a family in these conditions? I certainly hope you don't give them any
license's of a�y kind.
