1 WI�EREAS, Eagle Street Grille, Inc. d/b/a Eagle Street Grille, located at 174 7`" Street West in Saint
2 Paul, has requested a waiver of the 15-day norice requirement for expansion of the liquor service azea into the
3 compact and contiguous space at 178 7`" Street West which is immediately to the south of the cunent
4 establishment which will add 36 new seats; and
5
6 WHEREAS, the West 7�' Fort Road Federarion has ageed to the waiver of the notice requirements;
7 and
8 WHEREAS, the Council finds that the applicarion is in oxder and there aze no grounds for demal of
9 the license and that the failure to grant the waiver and the consequent delay in approving the license would
10 cause exceprional and unusual hardship to the license applicant; and
11
12 WHEREAS, the licensee agees that in the event a complaint is received prior to the expirahon of the
13 15-day period and the complaint pcovides a basis for adverse action against the license, that the Office of
14 License, Inspections, and Environmental Protection may diiect the hcensee to immediately discontinue all
15 operations unril a public hearing is scheduled, and that the licensee shall comply with said directive; now,
16 therefore, be it,

18 RESOLVED, that the 15 day notice requirements of § 409.11 of the Saint Paul Legislarive Code aze
19 hereby waived and e�ansion of the liquoi service area into the compact and contiguous space at 178 7' Street
20 Wesf which is immediateIy to the south of the currenf esfablishment which will add 36 new seats is hereby
21 approved for Eagle Street Grille, Ina d/b/a Eagle Street Grille, located at 174 7`" Street West in Saint Paul,
22 subject to the agreement stated above; and be it

24 FURTHER RESOLVED, that the expanded space shall not be occupied until a Certificate of
25 Occupancy is issued by the City of Saint Paul Building Official.
