No. 67, St. Pauli Minn, located at the northwest corner of Jackson Street and
University Avenue, that the provisions of said Zoning Code hereby are deter-
mined and varied as and to the extent necessary therefor, and that hereby
the building setback line of said premises in respect of the abutting line of
University Avenut _i.s:tade: coincident with said line of University Avenue;
that the 8 -foot setback requirement ordinarily applicable to the off - street
parking facility in respect of adjoining residential development, hereby is
entirely waived and made the subject of dispensation; and that a special

This is in the matter of Wilbert H. Roth's 1) appeal to establish a zero foot
building line from University Avenue, 2) appeal to relax the required 8 foot set-
back requirement for parking lots adjacent to a residential development, and 3)
application for a 53 car off- street parking lot accessory to a 53 unit motel to
be erected on property located at the northwest corner of Jackson Street and
University Avenue which is described as Lots 10, 11, 12 and 14 and that part of
vacated Capitol Heights adjacent to Lots 10 and 11, Auditor's Sub. # 67. The
,property is zoned commercial.
The subject property,which is vacant, consists of two separate tracts of land;
the larger, which is situated at the northwest corner of Jackson Street and Univer-
sity Avenue, is proposed to be developed with a 53 unit motel and 53 car off - street
parking facility; Lot 14 which is situated on the north side of University Avenue
between Jackson and Robert Streets is proposed to be developed with a restaurant
in conjunction with the motel. The larger of the two tracts consists of three
platted lots and that part of Capitoi Heights vacated adjoining said lots and has
a frontage of approximately 174 feet on University Avenue--and 164 feet on Jackson
Street resulting in an area of approximately 19,035 square feet. Lot 14 has a
frontage of 30 feet on University Avenue and an area of 3,219 square feet. North
and adjoining and fronting on Capitol Heights is a rooming house; east and across
Jackson Street is the Valley playground; south and across University Avenue is
vacant land recently cleared of a multi- residence structure; west and adjoining is
an apartment building which fronts on University Avenue and between the two subject
tracts is a residence which fronts on University Avenue.
Field investigation discloses no basic objection to the proposal, nor to the requested
appeals as outlined above. The waiver of the 8 foot parking lot setback affects
only one of the off- street parking spaces and would not deviate from the purpose
and intent of the Ordinance. The building line setback of zero feet from Univer-
sity Avenue appears reasonable as there is only one single - family residence in
the block and it is between the two subject parcels and is zoned commercial.
The Traffic Engineer has approved the parking lot plan which meets the standards
for this type of facility.
In consideration of the above factors, The Board of Zoning recommends 1) the
granting of the appeal to establish a zero foot setback from University Avenue,
2) the granting of the appeal to waive the required 8 foot setback for parking
lots adjacent to a residential use, and 3) the granting of the application for
a 53 car off-street parking lot in conjunction with a 53 unit motel operation
on the above described property in accordance with plans approved September 26, 1963.
