FoixtJr. and Michael J. Mooney, were injured on the 2nd day of August,1962, which injuries arose out of an automobile accident and which injuries occurred in the scope and course of the employment of said employes, and WHEREAS, the City of Saint Pail has paid, pursuant to the Workmen's Compensation Act, the sums of $43.00 on behalf of Roland R. Foix,Jr. and $66.00 on behalf of Michael J. Mooney, which sums were paid for hospital and medical attention, and WHEREAS, said employes have retained as their attorney James T. Denery, to recover damages for said employes arising out of the aforesaid accident, and WHEREAS, the sums paid by said City as aforesaid have been recovered, from which said sums the amount of $27.25, representing 25 per cent attorney's fees, has already been deducted, and WHEREAS, the Traveler's Insurance Company-has made payable to the City of Saint Paul in reimbursement of its expenditures made under the Workmen's Compensation Act the sum of $32.25 on behalf of Roland R. Foix,Jr. and $49.50 on behalf of Michael J. Mooney, now, therefore, be it RESOLVED, that the proper officials of said City may and are hereby authorized and directed to endorse those particular drafts of the Traveler's Insurance Company, to -wit drafts No. 5012390 and No. 5012392 in the amounts of $49.50 and $32.25 respectively, said sums to be credited to the appropriate accounts from whence payment was made under the Workmen's Compensation Act on behalf of the afore- said employes.
