RESOLVED, That the application therefor by
Jerry's Drive -In, owner of the subject premises situate on the north side
of California Avenue between White Bear Avenue and Flandrau Street and on
the west side of White Bear Avenue between California and LarpentearAvenues
described as the east 205 feet of the south 133.25 feet of the north 266.5
feet of Lot one (1) Kerwin's Outiots, situate in the City of Saint Paul,
that the application therefor hereby is granted and a permit, pursuant
to said application hereby is issued to said applicant authorizing the
eniaxgement and extension of the existing drive -in facilities established
on said premises in conformity to the plans therefor herewith filed subject
to said applicant's compliance with the following special conditions:
(1) That said applicant may construct and maintain at his own
expense a six (6) foot high louvered fence and screen
planting;; along the line of said premises to separate the
same from adjoining residential real estate;
(2) that there shall be no established means of ingress and
egress to or from said premises in connection with said
California Avenue upon which the same abuts;
(3) that said applicant forthwit shall procure all requisite
permits therefor/ and that /'Rid applicant's own cost and
expense adequate curbing along the line of said California
Avenue upon which said premises abut shall be constructed _
and installed; and f
(4) that said applicant shall not operate any motorized vacuum
cleaner on said premises between the hours of 12 o'clock r
midnight and 7 o'clock a.m. on any day.

in the attached letter of the Zoning Board, subject to the conditions

This is in the matter of the application of Jerry's Drive -In to enlarge an
existing drive -in facility located on the north side of California Avenue between
White Bear Avenue and Flandrau Street and on the west side of White Bear between
California and Larpenteur Avenues on property which is described as the east 205
feet,of, the south 133.25 feet of the north 266.5 feet of Lot 1, Kerwin's Outlots_..
The portion'of the tract now utilized for a drive -in restaurant was classified-t&-
a commercial district in 1950; that portion on which the enlargement will take
place (fronting on California Avenue) was rezoned to commercial.on June 11, 1963.
This is an "L" shaped tract of land with a frontage of 120.25 feet on the west
side of White Bear Avenue and 120 feet on the north side of California Avenue
having an area of approximately 24,515 square feet. North and adjoining is a
filling station which fronts on White Bear and Larpenteur Avenues, also the rear
yards of two single - family residences which front on Larpenteur Avenue and which
are approximately 6 -7 feet above the grade of the subject property; east and
across White Bear Avenue is the Hillcrest Shopping Center; south across California
Avenue is the recently constructed Gold Eagle Wash; west and adjoining is a
recently constructed single - family residence which fronts on California Avenue.
Field investigation discloses no basic objection as it is proposed to remove the
existing drive -in facility and construct a new building and to increase the parking
capacity by approximately 50 %. It is felt that this proposal will resolve many of
the problems now created by the existing establishment. Field investigation
further discloses that a 5 foot high louvered redwood fence and screen planting,
should be provided where this use immediately adjoins residential property and that
at no time should there be any means of ingress or egress provided off California
Avenue in connection with this facility, and that street curbing be constructed
along the California frontage of this property. The Traffic Engineer has approved
the plan which meets the required standards as well as the recommendations per-
taining to the fence, screen planting and street curbing.
In consideration of the above factors, the Board of Zoning recommends the granting
of the permit to enlarge the drive -in facility on the above described property in
accordance with plans approved June 20, 1963.
