2 WI�EREAS, a request has been received from Stuart Companies for the release of utility easement
3 rights in a portion of vacated Benson Avenue described as follows, and as referenced in Rea1 Estate
4 file number 07-C-01 and on map attached as Exhibit A:
6 The southeasterly half of that part of Benson Avenue being northeasterly of a Zine
7 beginning at the most southerly corner of Zot 17, C. W. Youngman's Rearrangement of
s Block 2, Palisade Addition to St. Paul, thence southeasterly to the most westerly
9 corner of Zot 16, block 7, Palisade Addition to St. Paul and there said line terminates
lo and lies southwesterly of the northwesterly extension of the southwesterly line of lot
11 13, block 7 of said Palisade Addition; and

13 RESOLVED, that based upon a Certificate of Intended Non-Use filed voluntarily by the Deparirnent
14 of Public Works for release of sewer easement rights, the Council of the City of Saint Paul, on behalf
15 of the City for itself and said department, does hereby waive and release the above-described easement
16 rights; as does Xcel Energy — Gas Division, a public utility; and Saint Paul Regional Water Services, a
17 municipal corporation; and be it fiirther

RESOLVED, that upon passage of this resolution, the proper City officials are hereby authorized and
directed to record a copy of this resolufion in the office of the Ramsey County Recorder; and that the
City Clerk shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this
resolution.
