RESOLVED, upon the separate appeals under the Zoning
Code, by Richard Gerlach, owner of the subject real property.'
situate in the City of Saint Paul at the southeast corner of
Ramsey Street and Western Avenuegr described as Lots 20 through
24, Block 2, Whitacre, Brisbane & Mullins' Subdivision, having
a frontage of 246 feet on the south line of said Ramsey Street
and 123.23 feet along the east line of said Western Avenue,
with an area of 30,376,square feet, that the provisions of said
Zoning Code hereby are determined and varied as and to the ex-
tent necessary therefor, and that the several permits sought
upon'said appeals hereby are granted, to -wit: that a permit
hereby'is granted for the establishment and maintenance of
a building setback line for the proposed multiple housing
building to be constructed on said "premises seven feet south-
erly therefrom and parallel to the south line of said Ramsey
Street, that a special permit hereby is granted for the con-
struction and maintenance, on said premises, of said proposed
multiple housing building, to consist of 11 stories represent-
ing a "height of 120 feet and to incorporate 80 separate housing
units, and that a special permit hereby is granted for the in-
stallation and maintenance on said premises of a presently
proposed 97 -car capacity off - street parking facility in con-
junction with said proposed 80 -unit apartment building; that
said special permits hereby are granted to said appellant as
such owner of said premises, subject to his compliance, other-
wise, with all applicable ordinances and State statutes.
RESOLVED FURTHER, that the said determinations and
variations of the application of the provisions of said Zoning
Code, Chapters 60 to 64, inclusive of the Legislative Code
of the City of Saint Paul, and each instance of the same here-
under are in harmony with the general intent and purpose of
said Zoning Code and necessary to provide against practical
difficulties or peculiar hardships in the way of icarrying out
the strict letter of the provisions-of said Zoning Code, so that
the public health, safety and general welfare may be secured
and substantial justice done; and

The City Council requested that you prepare a resolution or resolutions
granting the appeals of Richard Gerlach to (1),relax the density standards;
(2) relax the height limits for buildings; (3) change the building line
setback requirements for Ramsey St. from 12 ft. to 7 ft-l.; and granting
Mr. Gerlach's application for installation of a 97-car off-street parking
facility in conjunction with a proposed 80 -unit apartment building, on
property at the southeast corner of Ramsey St. and unimproved Western
Ave., as more fully described in the attached letter of the Zoning Board.

Dear Madam:
This is in the matter of the application of Richard Gerlach for appeals to
1) relax the density standards of Section 60.24 of the Zoning Code, 2) relax
the height limits for buildings of Section 61.02 of the Zoning Code, 3) change
the building line setback requirements of Chapter 62 for Ramsey Street from 12
feet to 7 feet; and for a permit for the installation of a 97 car off - street
parking facility in conjunction with a proposed 80 unit apartment building. The
subject property is located at the southeast corner of Ramsey Street and unimproved
Western Avenue and is described as Lots 20 through 24, Block 2, Whitacre, Brisbine
& Mullins Subdivision. The subject property also includes the west 33 feet of
Lot 26, and that part of Lisbon Street vacated and adjoining the west 33 feet of
Lot 26, Block 2, Whitacre Brisbine& Mullins Subdivision which fronts on the north
side of Oakland Avenue. All of this property is classified in the "C" residence
district and has been since 1922.
Field investigation discloses that the subject property is unique in character
because of its unusual topography and relation to adjoining streets as well as
being on the side hill of a natural bluff which separates the Summit Avenue
area from the lower West Seventh Street district.
Until recently this property was developed with two /*��family residences

As a result of the referral of this matter to the Board for reconsideration,
it was felt advisable to make a comparison study of the density and height
of this structure in relation to other recently constructed high -rise apart-
ments in Saint Paul. The following is submitted in tabular form for the benefit
of othe Council in making its finding.

After reconsideration of this proposal with particular emphasis on the building
ground coverage, number of square feet of' lot area per unit, building line set-
backs, the height of the proposed structure, and off- street parking, the Board
recommends 1) the denial of the density relaxation as requested,.2) the denial
of the relaxation of the height limit, 3) the approval of the building line set-
back from 12 feet to 7 feet.,aWith respect to the off - street parking plan', the
Board took no action on this matter at its meeting. However, the Board has
expressed its approval of the,off- street parking lot plan subject to the - Council's
approval of the density and height relaxation and the building line changes as
requested. `

We are acting in behalf of Mr. Richard Gerlach, the owner of the property
described as lots 20, 21, 22, 23 and 24, block 2, Whitacre Brisbine and
Mullin's sub = division of lots 1 and 2 of Leach's addition of out lots.
The property is presently residential and the owner proposes to build an
apartment building. We hereby request a relaxation of density standards
to permit an 80 -unit apartment building on the described site.
We also hereby appeal under provision of the zoning code to establish new
_building lines at the property line at front, sides and rear and to waive height
limitations to permit the construction of a building of 120 ft. height.
An application has previously been filed for a permit for a 100 -car parking lot
in connection with the apartment building.
Similar appeals regarding this building had previously been filed but no definite
action had been taken by the council to date. In lieu of recent new legislation,
we are renewing these appeals. The necessary fees which accompany these
appeals had been previously submitted. Since no action was taken, we assume
that the fees will be applied to these appeals.
All plans have been previously submitted to the zoning board and are on file in
their office for your review. Thank you for your consideration.
