I would like to confirm that a public hearing before the City Council is scheduled for Wednesday,
February 7, 2007, for the following case.

Purpose: Subdivision (Combined Plat) for Duckwall Division to create iwo single

City staff have reviewed the proposed subdivision, approved the Preliminary Plat on August 1&,
2006, with corrections, and signed off on the Final Plat on January 4, 2007. A staff report will be
prepared and provided to the City Council the week prior to the pubiic hearing.

• E. ZONING CODE CITATION: §69.301 states that pfatting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2%z acres or less in size, or (2) requires
paved streets, alieys and other public improvements, or (3) is previously unpiatted land. §69.304
lists conditions for lot splits and ad}'ustments of common boundaries. §69.406 provides criteria
for review of subdivision applications. These criteria are covered below under "Required
Findings."
F. HiSTORY/DISCUSSION: There is no zoning history for this property.
G. DISTRICT COUNCIL RECOMMENDATION: D'+strict 5 had not commented at the time this staff
report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the foilowing findings
sha11 be made prior to approval of a subdivision:
1. Af! the applicable provisions of the Legislative Code are complred wifh. City staff have
reviewed the proposed plat and have determined that all applicable provisions of city codes
are met. Parks and Recreaiion notes that if a new driveway is desired from Wheelock
Parkway, the applicanf must go through the parkland diversion process.
2. The proposed subdivision will �ot be detrimental to the present and potential surrounding
land uses. The proposed plat is consistent with the surrounding land uses, and will not be
detrimental to present and future use of surrounding land.
3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is
already developed and compatible with the proposed p{at.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
• conformance with the Land Use chapter of the comprehensive plan, which calls for a
mixture of housing for ai1 ages (Poficy 5.3.1) and cifij support for private markei efforts to
build new housing (Policy 5.4.2). It also conforms with redevelopment plans for the area.
5, The su6division preserves and incorporates the site's important existing natural features
whenever possible. The site is in a fu11y-developed part ofi St. Paul. The applicant has

shown a buiiding pad on the preliminary plat that avoids fhe steep slopes to the rear of the •
property.
6. A!I land intended for building sites can be used safely wifhout endangering residents by
peril from floods, erosion, confinuousfy high wafer table, severe soil conditions or other
menace. The site is in an area with no flooding, high water table or soil condifion problems.
A new residence can be buiit that avoids steep slopes and does not create erosion
probiems.
7. The subdivision can be economically served with public facilities and services. The
subdivision can be economically served with public facilities and services from surrounding
streets.
I. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approval of the preliminary and final plat for Duckwall Division subject to the following
conditions:
1. If in the future a driveway is requested to access Yhe property from Wheelock Parkway to
the new lot, the applicant shall go through the Parkland Diversion Process.
2. The applicant shall fi�e a copy of�the Council ResDlution approving the plat with the Ramsey
County Recorder's d�ce.
