'�' `� _411& 6,� The subject property is located on the north side of Harrison Street between Douglas and Garfield Streets and was developed in 1884 with a two -story i frame residence for two - family use, The records of the County Assessor's office show that this property was converted to its existing four - family use in 1927 and that the necessary permits were issued at that,time to make the conversion to a four - family use. The present owner is seling this pro- perty and has asked the enforcing officer of the Building and Zoning Codes for a certificate of occupancy. He has been advised by that office that this certificate cannot be issued as the present use is illegal because the property i6--classified "B" Residence District. The applicant is, therefore., under Chapter 64.13, Section "o", paragraph 2, of the Legislatim Code re- questing that the City Council legalize this existing four - family use, The subject property has a frontage along the north side of Harrison Street of 48.5 feet and extends to a depth of 123,24 feet, resulting in a site -area of 5,977 square feet which indicates that this property would meet the mini- mum density and ground- coverage requirements of the Zoning Code. Field in- vestigation also discloses there would be sufficient space at the rear part of the lot to provide the necessary off - street parking. The immediate area is developed substantially with single -and two - family uses with some indi- cation of transitibnal -uses taking place of a low- density multi- residential character. It appears that this transition will continue and that eventually this area will become predominately low- density multi - residential in character. .The Board of Zoning, at its regular meeting on March 13, 1963, heard the report of both the Planning Board staff and the applicant and recommends that the appeal to legalize the existing four - family use be igfanted. It is the opinionof the Board that because this use has existed since 1927 and permits had been granted for this extension, a denial at this time would constitute a hardship on the applicant, It also felt that because-•of the transition taking place in this area, this use would be compatible and would not be considered detrimental, The Building Department has advised that certain changes will be required in the electric wiring and plumbing before a certificate of occupancy can be issued. Need of appeal - the duplex was converted into a 4 -plex during the year 1927 and has been rented as a 4 -plex ever since. Within the past several years the property has been thoroughly modernized. There is in excess of one thousand (1000) square feet of house, and in excess of four thousand (4000) square feet within the lot boundaries. Taxes have been paid on the basis of a 4 -plea.
