O'Connell City Clerk Building Dear Madam: This is in reply to the referral of the appeal of John A. Prince to establish a 19 -foot building line setback for Lot 7, Block 3, Strub's Addition which is located on the south side of Cottage Avenue between Westminster Street and Highway 35E service road and which is classified in the "A" Residence District. The subject property has a lot frontage of 39 -7/10 feet along the south side of Cottage Avenue and extends to a depth of 108 feet resulting in an area of 4,288 square feet. This property was originally developed with a single - family residence in 1957 which was set back a distance of 24 feet from Cottage Avenue. Field investigation discloses that a 5 -foot by 12 -foot addition to the front of the existing residence has already been partially completed. The Building Inspector stopped work on this addition and advised the owner to obtain a building permit. The owner has advised this office that he engaged a carpenter to construct this addition with the assumption that said carpenter would apply for the necessary permits and now finds himself in the present position of having violated the Building Code. The minimum building -line setback in this block is 22 feet. There is one other single - family residence adjoining to the west in this block which is also set- back 24 feet. To the east and adjoining is a single - family residence which takes its setback from Westminster Street. The surrounding area uses are either single - family residences or vacant lots. It does not appear that a 19 -foot setback would have a detrimental affect on adjoining properties and that it would be in keeping with the purpose and intent of the Building Code. It should be pointed out that this relaxation would only apply to the east 20 feet of the subject property and that both of the adjoining property owners in this block have acquiesced in the applicant's request. The Board of Zoning, at its regular meeting March 13, 1963, after hearing the report of the Planning Board staff, and the applicant recommended approval of the applicant's request for a 19 -foot building line for Lot 7, Block 3, Strub's Addition. Prince, hereby respectfully request the Council to extablish a building "set -back line" of 8 (;eighteen) feet on Lot No. 7, Block 3, Strub's addition (322 East Cottage Avenue), for the addition to the front of existing residence. The addition will be approximately extended 5 (five) feet; the original residence is at 23 (twenty- three) feet, 9 (nine) inches.
