1 WHEREAS, on FeBiR'�ry 7, 2007, the City Council of the City of Saint Paul adopted Council File #07-122,
2 said Resolution being the R atification of Assessment for Excessive Consumption of Inspecrion Services
3 from July 3 to August 3, 2006 (File No. J0606E, Assessment No. 8266); and

5 WHERFAS, the property at 307 Michigan Street, being described as:

7 Winslow's Addition to Saint Paul Lot 9 and Lot 10 Blk 5;
9 with the property identification number 01-28-23-43-0071 was assessed an amount of $170.00 for
10 excessive consumption of inspection services; and
11
12 WHEREAS, the Legislative Hearing Officer recommends deleting the assessment due to communication
13 problems between the property owner and the City and the property owner's plan to bring the building into
14 compliance.

15 THEREFORE, BB IT RESOLVED, that the amount of the assessment for this properry be deleted, and
17
18 BE IT FURTHER RESOLVED, that the reduction of $170.00, plus any accrued interest, be funded by the
19 Exempt Assessment Fund. Council File #07-122 is hereby amended to reflect this change.

J0606E Excessive consumption of inspection services for property code violations from July 3
to August 3, 2006 far property at 307 Michi�an Street
This was approved by the City Council on February 7 and the Councilmember requested it be
referred back for another Legislative Hearing.
Mr. Betz stated orders were issued on January 13, 2005 to paint the trim on the house with a
compliance date of June 20, 2005. The property was re-inspected on September 1, 2005 and the
work had not been done and a bill in the amount of $70 was issued for excessive consumption of
inspection services. The properiy was re-inspected on November 28, 2Q05 and the work still had
not been done and a bill in the amount of $95 was issued for excessive consumption of
inspection services. The property was again re-inspected on July 28, 2006 and the work still had
not been done and again, a bill in the amount of $170 was issued for excessive consumption of
inspection services. The properiy was re-inspected on November 3, 2006 and the work still had
not been done and a citation was issued. At the hearing in December, the Court issued a fine and
ordered the work be completed by June 28, 2007.
Michael Gay, property owner, stated that he had purchased this Victorian-style home that had a
turret approximately three-and-half years ago. He had not realized when he purchased the home
that it would require some major, expensive renovations. He discovered that the trim on the
house had dry rot and was going require replacing many of the windows and trim around the
windows. He stated he had already replaced 10 storm windows and had approximately 15
windows that needed to be custom built as they were not regular size windows. He had obtained
an estimate from Marvin Windows in the amount of $1,050 far each window which was
extremely expensive and he did not have the finances available to replace all of the windows at
one time. He also stated that he had two elm trees that had to be removed due to Dutch elm
disease which was also extremely costly. He had recently contacted Pat Lindgren in
Councilmember Thune's Office and she put him in contact with the West 7th Fort Road
Federation to see if they had any financing available to assist him in replacing the windows. He
did admit that he was guilty of not communicating with the City inspectors concerning the orders
to paint the trim on the house which resulted in the assessments. He was going to attempt to
comply to have the work completed by June 28 as ordered by the Court.
Ms. Moermond stated she would recommend deleting the assessment. Ms. Moermond suggested
Mr. Gay contact PED, Xcel Energy and Kay Wittgenstein to see if there were any programs that
he may qualify for to obtain funding to assist with the repairs to his home. She also stated that a
separate resolution would be prepared to delete this assessment.
