THIS IS AN EMERGENCY ORDINANCE RENDERED NECES- SARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to- 649 inclusive, of the Saint Paul Legislative Code, pertain- ing to Use Districts, Height Districts, and Rezoning of ' certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to Commercial District, to -wit: Lots 1 and 2, Block 3, Drake's City of St. Paul, according to on file and of record in the o ter of Deeds in and for Ramsey being located at the northwest and Acker Streets. Braham to rezone from it B" residence to Commercial property located at the northwest corner of Jackson and Acker Streets which is described as Lots l and 2, Block 3, Drake's 2nd Addition. On January 18, 1963, the Commissioner of Finance reported the petition sufficient with the owners of 13 of a possible 19 (68.4 %) tracts of land within the prescribed 100 foot radius having signed the petition. The property is developed with a single - family residence which would be removed to permit the construction of a small commercial building for the purpose of relocating the tavern now located at the northeast corner of Jackson and Acker Streets. The site has a frontage of 72 feet on Jackson Street and 95 feet on Acker Street resulting in an area of approximately 6,840 square feet. North and adjoining is an apartment building; east and across Jackson Street is a tavern; south and across Acker Street is a trucking company parking lot; west and adjoining is a vacant lot, farther west is a transportation company. Field investigation discloses 'no basic objection to this reclassifica- tion. The Land Use Plan indicates the highest and best use would be for industrial purposes. In consideration of the above factors, the Board of Zoning recommends the granting of the petition to rezone the above described property to a commercial district.
