Summary Abatement Appeals: Page 5 Z J0615A Property cleanup from October 2 to October 16, 2006 for property at 458 Marvland Avenue East. This was approved by the City Council Council on January 17 and the Councilmember requested it be referred back for another Legislative Hearing. Mr. Betz stated orders were issued on September 26, 2006 to cut bushes and weed that had grown over and onto the public sidewalk with a compliance date of October 4, 2006. The property was re-inspected on October 9 and the work had not been done. A work order was sent to the Parks Department who did the work on October 11, 2006. An assessment in the amount of $258 was charged for the work done by Parks. Kim Knutson, property owner, stated he was in Denver and received a call from his neighbor that Parks was hacking at his bushes. He claimed the neighbor called him January and he did not believe he should be responsible for this assessment. Mr. Betz stated that the orders in the file clearly indicated that the work was done in October. Mr. Betz presented a video of the work that was done by Parks. Ms. Moermond stated she would recommend deleting the assessment since the video was unclear that bushes had actually been trimmed by Pazks. She also stated that a separate resolution would be prepared to delete this assessment. Mr. Knutson questioned why the City was constantly visiting his property. Mr. Betz stated that NHPI monitors tall grass and weeds along Maryland Avenue and this happened to be a field find. He reviewed the previous orders in the file and stated that orders were consistently one year apart to cut tall grass and weeds at his property. Mr. Knutson claimed that he had wild flowers in the corner of his yard and could not understand why anyone would have a problem with wild flowers. Ms. Moermond stated that from what she could see from the video, it did show that there were some weeds growing in the cracks of the sidewalk. She suggested Mr. Knutson keep his property and public right-of-way free from weeds so that he isn't consistently having the City issue orders at his property. The hearing adjourned at 11:15 a.m. Submitted by: Vicki Sheffer, Secretary Legislative Hearing Officer
