RESOLVED, upon the appeal, under the Zoning Code,
by Arlo Udst /uen, owner of the subject real property situate
in the City of Saint Paul on the west side of Lynnhurst
Avenue, between Prior and Oakley Avenues, described as all of
Lots 118 and 119 and that part of Lots 116 and 117 lying north
of a line drawn parallel to and 100.22feet south of the
north line of Lot 119, Union Park, that the provisions of
said Zoning Code hereby are determined and varied to the extent
necessary therefor, and that a permit hereby is granted for
the establishment and maintenance of a building setback line
of 25 feet, and that a-special permit hereby is granted for
the installation and maintenance of an 18 -car private off -

street parking lot on said property, in conjunction with a
proposed 18 -unit apartment building to be constructed on the
premises, in accordance with plans dated January 31, 1963, sub-
ject to said owner's compliance with all applicable ordinances

Dear Madam:
This is in the matter of Arlo.Udstuen's 1) appeal to relax the required 30 foot building
line setback to 25 feet, and 2) application for a permit to install and operate an 18-
car private off - street parking lot in conjunction with a proposed 18 -unit apartment
building to be constructed on property located on the west side of Lynnhurst Avenue be-
tween Prior and Oakley Avenues which is described as all of Lots 118 and 119 and that
part of Lots 116 and 117 lying north of a line drawn parallel to and 100.2 feet south of
the north line of Lot 119, Union Park. The property is zoned "C" residence.
The site is developed with a three -story frame residence which has been converted into
multi - residence purposes. The structure will be removed for the proposed apartment
building. This is an irregularly shaped tract of land having a curvilinear frontage on
the west side of West Lynnhurst Avenue of 109.3 feet and an average depth of approxi
mately 180 feet resulting in an area of about 18,220 square feet. The proposed building
will not be set parallel to the street line and only one corner of the structure will
fall within the requested 25 foot setback. North and adjoining is a rest home which
fronts on Lynnhurst Avenue; south and adjoining is a large frame residence which has been
converted into a multi- residence use and is owned by the applicant; west and across an
unimproved alley are various commercial and light industrial uses which front on Prior
Avenue; east and across Lynnhurst Avenue is a large residence converted to multi -
residence use and a hotel which fronts on Feronia Avenue.
Field investigation discloses no objection as the proposed development would be a vast
improvement over the existing use and the proposed 25 foot setback would not have a
detrimental effect on the adjoining properties. The average building setback in effect
would be approximately 38 feet. The Traffic Engineer has reviewed and approved the
parking lot plan which meets the standards for this type of facility.
In consideration of the above factors, the Board of Zoning recommends 1) the granting of
the appeal to establish a 25 foot building line setback on the west side of Lynnhurst
Avenue and 2) the granting of the permit for an 18 -car private off - street parking lot in
conjunction with a proposed 18 -unit apartment building in accordance with plans dated
January 31, 1962.
