Section 1. That the Zoning Code, Chapters 60 to'
64, inclusive, of th6 Saint Paul Legislative Code, pertain-

MEMORANDUM
John E. Flynn of 1092 Ashland Avenue called this morning and
said that on account of his health, he will not be able to
be here to object to a petition to rezone Lot 21, Block 42,
Summit Park Addition, from B residence to C.
He said that he objects because he thinks it will make his
property decline in value. He has no esthetic objection to
any proposed building, but feels that additional crowding of
the ighb orhood wit h some of the people who might be renters

This is in the matter of the petition of Thomas Dades to rezone from "B"
to 11C", residence property located on the north side of Ashland Avenue
between Lexington Parkway and Oxford Street which is described as Lot 21,
Block 42, Summit ParkAddition.
On January 2, 1963, the Commissioner of Finance reported the petition
sufficient with the owners of 12 of a possible 18 ( 66,2/3 %) tracts of land
within the prescribed 100 foot radius having signed the petition. The
subject property which has a 40 foot frontage and an area of 6,000 square
feet was developed in 1894 as a single- family residence and was remodeled
in 1915 to a two - family use. Recently the subject property was remodeled
for three - family use and the purpose of the rezoning is to legalize this
use. The adjoining and surrounding land uses are single and two - family
residences with the exception of a triplex across the street from the
subject property. Field investigation discloses that the proposed re-
zoning would constitute "spot zoning" and would not be in keeping with the
character of the area. The Proposed Land Use Plan indicates the highest
and best use of this land to be for single and two - family residences.
In consideration of the above factors, the Board of Zoning recommends the
denial of the petition to rezone the above described property to a "C"
residence district.
