WHEREAS, the State of Minnesota by and through its
Highway Department and the City of Saint Paul by and through
its Department of Public Work6 desire to enter into a mutual
agreement as regards certain storm sewer facilities to be
located at Hoyt Avenue and Inter -State Highway 35E, for which
said City has prepared certain plans and specifications for
the construction of a concrete pipe storm sewer connecting to
a 30 -inch storm sewer previously constructed by said City,
which said previously constructed atom sewer was deliberately
over -sized to allow for anticipated trunk highway drainage, ex-
pecting reimbursement from said State of Minnesota; and
WHEREAS, it is now proposed that the State pay the City's
proportionate share for the construction of the aforesaid storm
sewer at Hoyt Avenue and Inter -State Highway 35E, in mitigation
of the State's share of costs as relates to said 30 -inch pre-
viously constructed storm sewer, said City's proportionate share
of the storm sewer to be constructed at Hoyt Avenue and Inter -
State Highway 35E being estimated at $3,932.21, now, therefore,
be it
RESOLVED, that the proper City officials may be and hereby
are authorized to enter into a contract with the State of Minn-
esota subject to the concurrence of the U. Sr Bureau of Public
Roads whereby:
1. The City shall award a contract to the lowest respon-
sible bidder for the construction of the aforesaid storm
sewer to be constructed in accordance with plans and speci-
fications previously prepared and on file in the office of
the Commissioner of Highways for the State of Minnesota, and

2. That the State of Minnesota will pay to the City a
sum equivalent to the construction cost incurred by
said City and a sum equal to six percent (6 %) of the
amount of the State's share of said construction costs
as and for the proportionate share of the State of
Minnesota of all engineering and supervision costs in-
curred by the City in connection herewith, it being estimated
for accounting purposes that the total amount to be paid to
the City hereunder shall be the sum of $8,936.86.
