PAUL FAIR EMPLOYMENT PRACTICE COMMISSION ARTICLE I - OATHS Each member of the Commission shall comply with the Constitution of the State of Minnesota, Article 5, Section 8, and Saint Paul Municipal Charter Provision, Section 48, requiring officials to take an oath prior to engaging in any duties for or on behalf of the Commission. ARTICLE II - DEFINITIONS • Section 1. ORDINANCE The term "Ordinance" means City of Saint Paul Municipal Ordinance #10456, as amended, approved January 13, 1955, and as codified in the City of Saint Paul Legislative Code, Chapter 74. Section 2. COMMISSION • The term "Commission" means the Fair Employment Practice Commission as established by the Ordinance. Section 3. PERSON The term "person" includes any individual, firm, corporation, part- nership, association, legal representative, public or private, as found in Section 74.08 (2) of the Saint Paul Legislative Code. • Section 4. UNFAIR PRACTICE The term "unfair practice" means any discrimination as defined in the Ordinance. Section S. COMPLAINANT The term "complainant" means any person claiming to be aggrieved by an alleged unfair practice who files an initial complaint with the Commission as provided by the Ordinance. Section 6. INITIAL COMPLAINT The term "initial complaint" means a filed complaint in writing, signed by the complainant, identifying the respondent and setting • forth the details of the unfair practice complained of. • 2- Section 7. RESPONDENT The term "respondents` means any employer, labor union, employment agency, or other person, public or private, alleged to have com- mitted an unfair practice under the Ordinance. Section 8. INVESTIGATION OF INITIAL COMPLAINT The term "investigation of initial complaint" means that investi- gation undertaken by the Commission's representative prior to a determination of probable cause by the Commission.. Section 9. PROBABLE CAUSE The term "probable cause" means that there is a reasonable grounds of suspicion, supported by circumstances, sufficiently strong in themselves to warrant a cautious man in the belief that a person accused is guilty of the offense with which he is charged. Section 10. CONCILIATION AND PERSUASION The terms "conciliation and persuasion" mean those efforts by the Commission to eliminate the unfair practice complained of by • essentially educational non - coercive methods and avoiding in- quisitional impressions. Section 11. FORMAL COMPLAINT The term "formal complaint" means that complaint which pursuant to Section 74.09 (3) of the Ordinance is served upon the respondent by the Commission subsequent to a failure of conciliation and • persuasion. Section 12. ANSWER The term "answer" means the reply by the respondent to the formal complaint. Section 13. HEARING The term "hearing" means a public hearing held before the Commission. ARTICLE III - FORMAL COMPLAINT Section 1. FORM AND CONTENTS • The formal complaint shall be in writing, contain the names of the complainant and respondent, give the place and date of the hearing, give a clear and concise statement of facts alleging discrimination 3- and the alleged date or dates thereof, and inform the respond- ent of his rights: to file an answer, to appear in person or by attorney or otherwise, and to examine and cross - examine witnesses. Section 2. SERVICE The Commission shall issue and serve upon respondent, either per- sonally or by registered mail, a formal complaint at least ten (10) days before the hearing. The practice of the Commission shall be to set the hearing fifteen (15) days after service. Section 3. AMENDMENT OF COMPLAINT The formal complaint, or any part thereof, may be fairly and reasonably amended as a matter of right at any time before a • hearing thereon, and thereafter at the discretion of the Com- mission upon timely notice to respondent. • Section 4. WITHDRAWAL OF COMPLAINT The formal complaint, or any part thereof, may be withdrawn by the Commission and upon such conditions as it may deem proper. ARTICLE IV - ANSWER Section 1. TIME FOR FILING, FORM, AND CONTENTS The respondent has the right to file a written answer which shall • be signed and verified by the respondent. It shall be filed in duplicate with the Commission within ten (10) days after receipt of the formal complaint. The Commission shall transmit one copy to the complainant. Service on the Commission shall be at the office of the Commission by mail or in person. The answer shall contain a general or specific denial of each and every allegation of the complaint controverted by the respondent, or a denial of any knowledge or information thereof, sufficient to form a belief, and any matter not so denied or controverted shall be deemed admitted. Section 2. EXTENSION OF TIME TO FILE ANSWER The Commission may, for good cause shown, grant an extension of time to file an answer to the formal complaint. Section 3. DEFENSE AND NEW MATTERS • Affirmative defenses shall be specifically alleged. Any allegation ' of new matters contained in the answer of respondent shall be deemed denied by complainant without the necessity for a reply. 0 4- Section 4. AMENDMENT OF ANSWER An answer, or any part thereof, may be fairly and reasonably amended as a matter of right at any time before hearing thereon, or at the hearing at the discretion of the Commission. In any case where a complaint has been amended, the respondent shall have an opportunity to amend his answer within such period as may be fixed by the Commission. ARTICLE V - HEARING Section 1. COMMISSION TO CONDUCT HEARING - QUORUM The Commission shall conduct the hearing which shall be open to the public, and the Chairman of the Commission or any member thereof whom he shall appoint shall preside. The hearing shall be conducted by at least three (3) Commissioners. All witnesses shall testify under oath which shall be administered by the pre- siding officer. Section 2. CONDUCT AT HEARINGS • A. The case in support of the complaint shall be presented before the Commission by the Executive Secretary. B. The Executive Secretary and respondent or his attorney or representative shall have the right to examine and cross - examine witnesses, to make objections, to present rebuttal evidence, to submit oral arguments, and to file briefs • within such time limits as the Commission may determine. C. The Commission shall have full authority to control the procedure of the hearing, to admit or exclude testimony or other evidence, and to rule upon all objections. The rule of privilege shall attach to all matters discussed during a conciliation and persuasion meeting. D. All rulings and determinations by the Commission shall be by majority vote. E. The Commission may continue a hearing from day to day or adjourn it to a later date or a different place by announce- ment thereof at the hearing or by appropriate notice. The Commission may also recess the hearing for the purpose of deliberation on any matter, proceeding, motion, or objec- tion,, or for any other appropriate purpose, in its discretion. • • S- F. The Commission may grant a continuance for good cause shown, . upon motion timely made. G. Stipulations in writing may be entered into by the Executive Secretary and the respondent, his attorney or representative, if signed by the same, and may be intro- duced in evidence at the hearing. H. 1. The Commission on its own motion may, whenever justice so requires, reopen any matter previously closed by it, upon fifteen (15) days notice of such reopening being given to all parties. • 2. A complainant, respondent or intervenor may, for good cause shown, apply for the reopening of a previously closed proceeding. 3. Upon application duly made, the Commission, in its discretion, may, within sixty (60) days of service of its order or within such lesser time as the Commission may seek relief in the district court, reopen any matter previously closed where • a decision was rendered upon the default of a party affected thereby. I. The Commission may exclude from the hearing any person who engages in improper conduct before it. Section 3. INTERVENTION . Any person having an interest in the controversy may in the dis- cretion of the Commission be allowed to intervene in person, or by his attorney, or agent, for such purposes and to such extent as the Commission shall determine. Section 4. ADMISSIBILITY OF EVIDENCE The Commission shall admit evidence which possesses probative value and shall exclude evidence which is incompetent, irrelevant, im- material, and repetitious. Section 5. RECORD OF HEARING A record shall be made of the hearing, including all testimony, proceedings, motions, and objections. LJ M ARTICLE VI - CONSTRUCTION AND EFFECT Section 1. EFFECT These rules of procedure and practice for hearings shall be subject to amendment at any time, and the Commission may adopt additional rules whenever the same are deemed necessary for orderly procedure. Section 2. LIBERAL CONSTRUCTION OF RULES These rules shall be liberally construed to accomplish the pur- poses and policies of the Saint Paul Fair Employment Practice Ordinance #10456, as amended. ARTICLE VII - FINDINGS, RECOMMENDATION, DISMISSAL, OPINION Section 1. FINDINGS, RECOMMENDATIONS, DISMISSAL ORDER After hearing the matter the Commission shall determine upon all • the evidence whether the respondent has engaged, or is engaging, in an unfair practice. If the Commission finds that the respond- ent has engaged, or is engaging, in an unfair practice, the Com- mission shall state its findings of fact and conclusions of law, and shall render such recommendations as the findings warrant. If the Commission finds that the respondent has not engaged, or is not engaging in, an unfair practice, the Commission shall state its findings of fact and conclusions of law, and shall issue and serve upon the complainant and respondent, either by delivery or by mail, an order dismissing said complaint. Section 2. OPINION The Commission shall issue a written opinion stating its findings of fact, conclusions of law, and recommendations or dismissal order. Section 3. INCLUSION IN RECORD The statement of findings and recommendations or dismissal order under Section 1 shall be included in the record.
