07-215Council File # �I ] Resolution i# RESOLUTION Green Sheet � 3037037 PAUL, MINNESO7A 1 2 , � 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2? 28 ?9 30 31 32 33 34 Presented By Refened To � WHEREAS, Chapter 293 of the Saint Pau1 Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and WHEREAS, Mount Zion Temple, represented by Ellen Konstan, Picnic Co-Chair, who has been designated as the responsible person on the application, has applied for a variance to present live music at Mount Zion Temple; and WHEREAS, applicant is seeking a variance for the hours of 11:00 a.m. to 4:00 p.m., on May 6, 2007; and WHEREAS, if applicant is not granted a variance it wi11 not be able to present live music at Mount Zion Temple at 1300 Summit Avenue; and WHEREAS, the Office of License, Tnspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions far the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Mount Zion Tem�le, subject to the following conditions: 1) The variance shall be for the hours of 11:00 a.m. to 4:00 p.m., on May 6, 2007. 2) All electronically powered equipment used in conjunction with the event shall not exceed 90 dBA, as measured at 100 feet from the source.
