RESOLVED, Upon due consideration of the per-
tinent application therefor by Crown Builders, Inc., owner
of the subject real estate situate in the City of Saint
Paul, described as follows: Lot 16, Block 5, Hillsdale,
St. Paul, Minn.,, said applicant and its successors and
assigns, in respect of said premises, hereby are granted
a permit to construct, maintain and operate a 31 -car
capacity offstreet parking facility thereon, in accordance
with the approved plan therefor herewith f ilea and subject
to compliance by said applicant or its successors and as-
signs, with - -9711': - erwise pertinent provisions of munici-
pal ordinances, state statutes and rules and regulations of
public authorities having cognizance, and further subject to
the obligation hereby imposed upon said applicant and its
successors and assigns, to grade and surface, at its or
their own separate cost and expense, the public alley upon
which said premises abut, from Duluth Street to the point
of ingress and egress to and from said premises, in con-
nection with said public alley, more particularly as the same
is indicated on said approved plan, said improvement of said
public alley to be made in accordance with plans and speci-
fications therefor to be prepared and furnished by the Com-

Dear Madam:
This is in answer to the Council's referral of the application of Crown
Builders Inc., to construct a 31 -car off - street parking lot on Lot 16,
Block 5, Hillsdale Addition. The subject property is situated on the
east side of Duluth St. between Lawson & Cook Aves. and is classified in
the light industrial di- strict. It- should be mentioned that the City
Council granted an informal approval of this application on October 30,
1963.
It is proposed to develop the site with a 31 -unit, 2 -1/2 story apartment
building with an off - street parking lot accessory to the apartment build-
ing for 31 cars.
Field investigation discloses that the area is entirely developed with one -
and two - family residence uses and that it would be desirable to have the
subject property developed as such. However, because the property is classi-
fied in the light industrial district it could actually be developed for
industrial purposes and, therefore, the apartment proposal would be a
more desirable use.
The site has a street frontage of 97.2 ft. along Duluth St. and extends
320 ft. in depth resulting in an area of 31,104 sq. ft. Because of the
narrow accessible street frontage for a tract of this size and its extreme
depth it cannot be divided into reasonable one- or two - family residence
lots and, therefore, lends itself best to multi- residence use.
The Traffic Engineer and Planning Board staff have reviewed this matter and
recommend approval of this application with the stipulation that the adjoin-
ing public alley as platted be graded and surfaced from Duluth St. to the
point of ingress and egress to the parking lot in accordance with all city
regulations and specifications of the Public Works Department and, further,
that said grading and surfacing be done at the applicant's expense.
In view of the above finding the Board of Zoning at its October 10, 1963
meeting recommended approval of the 31 -car off - street parking lot request
as the proposal meets the density standards of the Zoning Code for multi-
family residential use and would be desired over an industrial use whic

THIS AGREEMENT, Made this 19th day of December,
1963, by and between Crown Builders, Inc., a Minnesota
corporation, and the City of Saint Paul, a Minnesota mu-
nicipal corporation, pursuant to that certain Resolution,
of the Council of said City, Council File No. 215692, ap-
proved December 4, 1963, hereby incorporated herein end
made part and parcel hereof by reference, with the same in-
tent, purpose and effect as if said Resolution were set
forth herein verbatim, and whereunder and whereby provision
was made, subject to the terms and conditions of the same,
for the grant by-said City to said Crown Builders, Inc., its
successors and assigns, of a permit, pursuant to the per-

and to make due application for the requisite permit therefor

by the Council of said City, and to accordingly bind said
Crown Builders, Inc., and its successors in interest, unto
said City; such acceptance incorporating such covenant being
thereby provided to be filed not later than thirty (30) days
next after the approval of said Resolution, December 4, 1963;
NOW, THEREFORE, said Crown Builders, Inc., for itself
and its successors and assigns, hereby accepts said Resolution,
Council File No. 2156929 approved December 4, 1963, and said
permit thereby granted, subject to all of the provisions,
terms and conditions set forth in said Resolution; that said
Crown Builders, Inc. hereby covenants and binds itself and
its successors and assigns unto said City of Saint Paul to
fully and faithfully perform all of its obligations specified
under said Resolution, in accordance with the provisions,
terms and conditions of the same including, among others,
its obligation and that of its successors and assigns, to
grade and surface said section of public alley, in accordance
