WHEREAS Claude E. Duke- and Thomas F. Carroll, employes
of the Department of Public *ork§ of the City of Saint Paul
were injured in a third party accident on July 31, 1963, while
engaged in the performance of their duties for said Department
of Public Works; and
WHEREAS on behalf of said Claude E. Duke, the City has
incurred medical expenses in the amount of $46.00 and has paid
workmen's compensation benefits to said employe in the amount
of $18.00 for loss of time from work; and on behalf of said
Thomas F. Carroll the City has incurred medical expenses in the
amount of $30.00; and
WHEREAS a settlement has been negotiated by and between
said Claude k. Duke and Thomas F! Carroll, thin ugh their counsel,
Bernard N. Litman, and the thirdiparty involved in said accident
and included in said settlement the City will receive full
reimbursement for its medical expenses and compensation paid
on behalf'of its employes, less 25 per cent attorney fees °to
said Bernard N. Litman, now, therefore, be it

RESOLVED, That the proper City officers are hereby authorized
to accept and endorse drafts from the insurer of said third party
involved in said accident, b deposit the same to the 'Workments
Compensation Account and to pay out of said settlement a sum
equal to 25 per cent of the same i to said Bernard N. Litman, as
and for attorney's fees for the recovery of the Cityt s subrogation
claim; and the proper City officers are hereby authorized to
execute any necessary releases in connection with said settlement.
