WHEREAS, under Council File No. 214544, adopted by
the Council September 3, 1963, and published September 7, 1963,
permission was given to Mobil Oil Company to install and operate
a gasoline filling station at the southwest corner of St. Paul
Avenue and West Seventh Street, more particularly described as
Lots 1, 2, 3 and 4, C. W. YoungmaAs 2nd Addition to Saint Paul,
in accordance with revised final plans dated August 12, 1963;
and
WHEREAS, request has been received from Mobil Oil
Company, 606 Vandalia Street, asking that said Company be allowed
to vary the normal gradient on the City's standard street cross
section from the curb to the property line from 40.021/ft. to
- 0.021 /ft. as shown on the printing attached hereto and made a
pa(rt hereof by reference, the same having been examined by the
Office of the City Engineer and approved by them; now, therefore,
be it
RESOLVED, That permission is hereby granted to Mobil Oil
Company to deviate from the standard street cross section of the
City of Saint Paul by varying the normal gradient from the curb
to the property line from +0.021 /ft. to - 0.02' /ft., subject to the
following requirements and restrictions:

c. That said Mobil Oil Company shall provide a
bond, conditioned to protect the City of Saint Paul
from any and all claims arising against said City be
reason of the variance of said sidewalk and the con-
struction thereof and the use of said filling station
in relation to said sidewalk, said bond to be in the
penal sum of $5,000.00 running in favor of the City
of Saint Paul, and to continue .in full force and effect
until such time as the operation of said automobile
gasoline filling station shall- cease, notwithstanding
a transfer of ownership, but not of use of said premises,
from Mobil Oil Company.
