Rein Development Company, owner of the subject real estate situate in the City of Saint Paul, classified under said Zoning Code, partially in "A" Residence District and partially in "C" Residence District, abutting on the south line of St. Paul Avenue between Davern Street and Snelling Avenue extended, described as that part of Lots 15, 16, 17, 22, and 23 lying south of St. Paul Avenue and northerly of a line 140 feet north of and parallel to the north line of Wilmot Avenue produced east across said Lots 15, 16, 17, 22,and 23, Snelling Outlots, Ramsey County, that the provisions of said Zoning Code hereby are determined and varied, as and to the extent necessary therefor, and that a special permit hereby is granted to said applicant, to run with the land, for extension of "C" Residence District uses over the entire hereinabove described real estate and that the building set -back line for said real estate, in respect of the. °south line of St. Paul Avenue upon which the same abuts, hereby is established as a line drawn across said real estate parallel thereto and 15 feet distant from said south line of St. Paul Avenue; and that, upon the pdrtinent application by said C. O'Connell City Clerk Building Dear Madam: This is in the matter of the C. G. Rein Development Company's 1) appeal to establish a 15 foot building line setback from St. Paul Avenue, 2) appeal for an extension of the L'C" residence use permitted on a portion of the site to the entire tract, and 3) application for a permit for a 192 car off- street parking lot in conjunction with sixteen 12 -unit apartment buildings on pro- perty located on the south side of St. Paul Avenue between Davern Street and Snelling Avenue extended which is described as that part of Lots 15, 16, 17, 22 and 23, lying south, of St. Paul Avenue and northerly of a line 140 feet north of and parallel to the north line of Wilmot Avenue produced east across said Lots 15, 16, 17, 22 and 23, Snelling Outlots Ramsey Countyg All but the easterly 33 feet of the site is zoned "C" residence and has been since August 11, 1962; the balance is "A" residence. The subject property has a frontage of 1,285.4 feet on the south side of St. Paul Avenue extending to a depth of 192.25 feet, resulting in an area of approximately 246'x-154 square feet. I'n order to develop the property as proposed, it is necessary to secure Council approval to relax the established 19 foot building line to 15 feet, and to extend the "C" residence use per- mitted on the major portion of the site to the entire tract. North and across St. Paul Avenue is McDonough Park; east and across unimproved Snelling Avenue is a single - family residence which fronts on West - Seventh Street; south and adjoining is the Ford spur trackage; west and across Davern Street is the Jewish Community Center now under construction. Field investigation discloses no objection to this proposal as the property was rezoned for apartment use, and it is in accordance with the proposed Land Use Plan. The relaxations as requested are reasonable and in keeping with the purpose and intent of the Zoning Code. The proposal meets the standards for density and building ground coverage. The-Traffic Engineer and the Plann- ing Board staff have reviewed the plans which meet the standards for this type of facility, and recommend approval. In consideration of the above factors, the Board of Zoning recommends the granting of the appeals as above outlined, and the granting of the appli- cation for a 192 car off - street parking lot on the above described property in accordance with plans approved October 10, 1963. G. Rein Development Co. hereby petitions the City of St. Paul to: 1), ; establish a building line on the property described as "That part of Lots 15, 16, 17, 22 and 23, lying South of St. Paul Avenue and Northerly of a line 140 feet North of and parallel to the North line of Wilmot Avenue produced Feast across said Lots 15, 16, 170 22 and 23, Snelling Outlots, Ramsey County. The property involved in both items is located on the South side of St. Paul Avenue between Davern Avenue and South Snelling Avenue and North of the right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad. At the present time this land is vacant. We propose building sixteen 12 -unit apartment buildings on the site. We petition the City of St. Paul to set the building line along St. Paul Avenue at 15 feet for this block between Davern and South Snelling Avenue. The reasons for requesting this 15 foot building line are to provide more distance between the buildings and the railroad right-of-way and to provide more distance between the buildings and the parking lot drive. In addition it should be noted that St. Paul Avenue is 104 feet wide and that no buildings will be built on the North side of St. Paul Avenue as that property is dedicated to the City of St. Paul for park purposes. We petition the City of St. Paul to extend the "C" Residential zoning to include the Fast 33 feet of Lot 15, Snelling Outlots. When Lots 15, 162 172 22 and 23 were rezoned some time ago, the Fast 33 feet of Lot 15 was not rezoned. We propose to use this 33 feet in conjunction with our apartment.house development.
