O'Connell City Clerk Building Dear Madam; This is in the matter of the appeal of Thomas Poeschl Sr. to waive the required 40 foot minimum frontage for single - family residences in a "B" residence zone on property located on the south side of Van Buren Avenue between Grotto and St. Albans Streets which is described as Lot 12 except the westerly 3 feet, St.Albans Street Addition. The subject property was formerly the yard area of the two - family residence to the west and it is proposed to develop it with a single- family residence. The site has a frontage of 37 feet on the south side of Van Buren Avenue and extends to a depth of 124 feet, result- ing in an area of 4,588 square feet. While the subject property ex- ceeds the required area standards, it is short-3 feet of the minimum frontage requirement, and it is necessary to secure Council approval for the proposed construction. The surrounding area uses are entirely single and two - family residences. Field investigation discloses that it would be reasonable to waive the minimum 40 foot width requirement as -the proposed structure will maintain the side yard requirements of the Building Code and will not be closer than approximately 11 feet to each of the adjoining residences. In consideration of the above factors, the Board of Zoning recommends the granting of the appeal to relax the required 40 foot minimum width to permit the erection of a single - family residence on the above described property. Poeschl, am writing of Lot 12, Except the Westerly 3 in order that I might construct located on the South side of Van from Grotto Street. OCT 11363 CIT PLANNING �BOALW this letter to appeal the zoning feet, St. Albans St. Addition, a single home on same. This lot is Buren and is the fourth lot East On August 13, 1962, we purchased Lot 12 from Fred E. Welte, Jr. and Margaret J. Welte, who at that time owned Lots 12 and 13, at the price of $2,035.00 with the intention of building a home. Due to a sidewalk running along side the home on Lot 13 we were unable to purchase a full 40 foot lot; but due to the fact this 3 feet would not alter the appearance of Lot 12 we bought 37 feet. Before buying this property we called the City Architect's Office to find out the zoning and building codes to see if we could build on a 37 foot lot in the city and were tnld we could as long as we complied with the city code and stayed 3 feet from the property line on each side, lined up with the homes on the rest of the block, and had room for off - street parking. The reason for this appeal is that after purchasing this lot, clearing two tree%-3 from it, and making all arrangements for build- ing and financing, we applied for a building permit on September 25, 1963, and were told we could not build on this lot as the law prohibits building on a newly created lot uuless it has a 40 foot frontage, if it has been created since 1922. The gentleman we talked with in the City Architect's office made no mention of this at the time we purchased this lot. We are appealing this Ordinance under Legislative Code, Chapter 64.03 Paragraph (i). As shown on the enclosed Plat of Survey, there was a garage which stood 4.6 feet on Lot 12 when we bought it, but when Mr. Welte sold the duplex on Lot 13 this garage was moved off. We believe this home will i1prove this lot, which is now cleared and vacant, and will in no way detract or decrease from the valuation of the homes in this area.
