COMMISSIONER-
RESOLVED, that Erickson Petroleum Corporation, a Minnesota corporation,
pursuant to its pertinent application therefor and as owner of the subject
real estate situate in the City of Saint Paul, described as Lots 1, 22 39 49
Block 2, Moller's Addition, hereby is granted a permit to install, maintain,
and operate a new gasoline service filling station at the southwest corner of
Otto Avenue and West Seventh Street, where said real estate abuts, in conformity
with the approved plans therefor, a copy whereof is filed herewith, subject to
the following provisions, terms, and conditions: that said authorized station
shall not be open for business nor shall any business be transacted on said
premises on any day between the hours of 12 o'clock midnight and 6 o'clock a. m .;
that costs incurred by the City in relocation or in removal or replacement of
City -owned traffic control ducts made necessary by any installation by said
permittee hereunder, shall be made the subject of full reimbursement hereby required
to be made on such account by said permittee to the City upon the delivery of
the City's invoice therefor to said permittee, and that said permittee, its
successors and assigns shall at all times in respect of the installation,
maintenance, and operation of said station on said premises, make due com-
pliance with all applicable State statutes and municipal ordinances.

The City Council requested that you repare a resolution granting the attached
application of Erickson Petroleum oD. for permit to install and operate a new
gasoline filling station at the southwest corner of W. Seventh and Otto Ave.,
also described as Lots 1., 21 31 41 Block 21 Moller's Additiono in accordance
with plans approved March 13, 1963, and subject to the conditions that the
station shall be closed between the hoursopf 12 o'clock midnight and 6 :00 A.M.
and further, that the costs incurred and/work caused due to the disturbance
of existing traffic control ducts shell be paid by the applicant as said
condition is more fully explained in the attached letter of the Zoning Board.

Dear Madam:
This is in the matter of the application of the Erickson Petroleum
Company for a permit to install and operate a new filling station
on property located at the westerly intersection of West Seventh
Street and Otto Avenue which is described as Lots 1, 2, 3, 4, Block 2,
Moller's Addition. The zoning is commercial and has been since 1922.
The property is vacant, having recently been cleared of two single -
family residences, and is irregular in shape having a frontage of
152 feet on the north side of West Seventh Street, 142.25 feet on
the southwest side of Otto Avenue, and 48.5 feet on the south side of
Paliber Place, resulting in an area of approximately 12,104 square feet.
Southwest and adjoining are several single - family residences which front
on West Seventh Street; north and across Otto Avenue are single - family
residences fronting on said street; at the northeast corner of Milton
Street and W. Seventh Street is a recently constructed filling station;
southeast and across W. Seventh Street is a filling station and tank
farm; directly east and across the intersection of West Seventh Street
and Otto Avenue is a parking lot in conjunction with a commercial use.
Field investigation discloses no basic objection as all the other cor-
ners at this intersection are developed commercially, and all of the
property fronting on West Seventh Street in this-block is zoned commer-
cial and has been since the enactment of the Legislative Zoning Code in
1922. The Traffic Engineer has reviewed the plan and recommends appro-
val. However, he points out that any costs and /or work incurred due
to the disturbance of existing traffic control ducts now installed in
the Otto Avenue boulevard sbobld be absorbed by the applicant, and that
if such work is contemplated the applicant should notify the Traffic
engineer's office prior to commencing such work. The plan meets the
standards for this type of facility with the exception of the ten -foot
screen planting buffer which normally is provided along the entire length
of the property where it adjoins a residential use. It is the appli-
cant's intent to provide the 10 foot screen planting buffer from the
West Seventh Street frontage to the rear of the adjoining residence;
from that point to the rear of the lot, a 3J foot redwood louvered fence
would be built along the property line separating the proposed use and
the adjoining residence. A letter of acquiescence from the adjoining
neighbor has been filed.

In consideration of the above factors, the Board of Zoning recommends
the granting of the permit to install and operate a new filling
station on the above described property in accordance with plans
approved March 13, 1963. .

Code.

We the undersigned, residents living in the vicinity of 7th Street
and Otto Street in the City of Saint Paul, do hereby respectfully petition
your honorable body to deny the application of the Erickson Refinery to
construct a filling station and premium center at the Northwest corner
of 7th and Otto Streets, for the following reasons:
1. This intersection already has two major brand filling stations
and an On Sale liquor establishment located there; behind the Shell station
at the Southwest corner is St. Paul's largest tank farm for the storage
of petroleum products. There is no need for any further filling stations
at this location, or area.
2. Otto Street is the westerly end of Shepard Road, and its inter-
section with 7th is one of the busiest and most dangerous in town during
the morning and,evening rush hour. Construction of another station will
only add to the present danger to pedestrian and vehicular traffic, and
will constitute a nuisance.
3. The long hours which a station of this type will be operated will
result in high intensity lights bothering nearby residents and reducing
the value of their properties
4. While West 7th has long been zoned commercially, it has been, not
in a small way, developed for homes as well. The people of this area did
not object when the council recently transferred an On Sale liquor license
to this corner; they did not object to the two existing stations, or the
tank farm. We feel that the proposed development goes toafar, and to
grant it would be in violation of our rights as citizens and put business
ahead of people.
WE URGE YOU TO DENY THIS PETITION AS IF GRANTED WILL CONSTITUTE A
NUISANCE AND A TRAFFIC HAZARD.

Gentlemen:
Recently the City Council referred to the Traffic Committee for
study and recommendation an application of the Erickson Petroleum Co.
to operate a service station at the southwest corner of W. Seventh and
Otto. The Committee reviewed this matter at their regular meeting on
April 29, 1963 and concluded that there was no justification to recom-
mend against the installation on the basis of traffic movement. The
committee recognized that all service stations caused some traffic gen-
eration including occasional movements that are not extremely desirable,
but this station would cause no unusual traffic problems.
