WHEREAS, Kraus - Anderson of St. Paul Company, general t' $
contractor of the Dayton Company for the construction of that
particular building bounded by Wabasha, Seventh, Cedar and
Sixth Streets, is agreeable to the payment to this City of the
sum of $3,600.00 representing the contribution of said general
contractor toward replacement and resurfacing of Cedar Street,
allegedly damaged during the construction -of said building; and
WHEREAS, said contribution aforesaid does not constitute
an admission of liability by said Kraus- Anderson of St. Paul
Company in relation to said Cedar Street or claims arising out
of or near to said described building; and
WHEREAS,
is requested that
and claims arising
further, that said
the replacement of
be it
in consideration of said contribution, it
said City assign to Kraus - Anderson its rights
out of the damage to said Cedar Street and
City expidite the letting of a contract for
said Cedar Street surfacing; now, therefore,
RESOLVED, That the proper City officials are hereby
authorized to accept said contribution and to deposit said funds \1
in accordance with the_deaires and advice of the City Comptroller;
and .
RESOLVED FURTHER, That the proper City officials may be
and hereby are authorized to execute the contemplated assignment
as prepared and approved by the Corporation Counsel.
