February 15, 2007 939 AM Page 1 07-��-� LICENSE HEARING MINUTES Hoovers Pub LLC at 755 Jackson Street �� D Tuesday February 13, 2007, 10:00 a.m. 330 City Hall, 15 Kellogg Boulevazd West Mazcia Moermond, Legislative Hearing Officer T1�e hearing was called to order at 10:01 a.m. Staff Present: Jeffrey Fischbach and Kristina Schweinler, License, InspecHons and Environmental and Protecfion (LIEP); and Jean Birkholz, Council Research. Others Present: Gregory Hanson and Pamela Hanson, owners; and Lynn Natus, a previous owner. Hoovers Pub LLC: Liquor On Sale —100 seats or less, Liquor On Sale — Sunday, Entertainment (A), Restaurant (B) — more than 12 seats, Gambling Lpcation and Cigarette/'I'obacco licenses. Ms. Moermond stated that this license application is far a Class N License which requires neighborhood notification. Other Class N Licenses include: auto body, auto sales, etc., things that have an immediate impact on their neighbors. The City received one letter of objection to the issuance of this license which means that a Legislative Hearing was necessary. Ms. Moermond explained that there are three (3) possible outcomes to this heazing. She could: 1) recommend to the City Council that they grant this license without any conditions; 2) recommend to the City Council that they grant this license with agreed upon conditions; or 3) recommend to the City Council that they refer this matter to an Administrative Law Judge, which usually takes from four (4) to six (6) months. Ms. Moermond would use this option if she thinks that there's no way that this business is workable at this location or if she thinks that there are conditions that are absolutely necessary to make it warkable that the applicant finds unacceptable. Ms. Moermond's recommendation will come to the City Council as a resolution and it will appear on the Consent Agenda. Ms. Moerxnond will begin with a staff report. Staff will be asked to explain their review of the application, and wiil also explain their recommendation. Then, she will ask the applicant to talk about the business plan. Next, she will iook at the concerns voiced in the letter of objection that was received and talk about them. Finally, Ms. Moermond will make a recommendation which will be presented to the City Council. Mr. Jeffrey Fischbach, License, Inspections and Environmental Protection, provided a staff report. He stated that this application is from G& P Holdings Inc., doing business as Hoovers Pub LLC at 755 Jackson Street, Crregory Hanson, president. Currently, these licenses are held by Scooters LLC, doing business as Scooters. G& P Holdings Inc has been operating under a management agreement since November 6, 2Q06. LIEP has not received any comment from the District 6 Planning Council. Environmental Health has done their inspection, pending approval with payment of the plan check fee, which will be paid today. Fire, Licensing, and Zoning have already approved this. LIEP recommends approval without conditions. The current license is due to expire on February 28, 2007. Mr. Hanson explained that the baz business is a new venlure for him. He has been retired for the last 2-3 yeazs and was getting bored, so he decided to get into business with a bar that he has patronized over the yeazs. There are three (3) city lots on which this property is located. Mr. Hanson is at the business early morning, early afternoon as well as early evening every day. His wife comes down in the afternoon after her day job at Cub Foods in Sunray to take caze of the books. 6 � �155' Ms. Moermond asked about police calls to the baz. Mr. Hanson responded that there hasn't been a police call to that particular bar for five — six (5-6) years. Eighty-five (85%) percent of his patrons are over forty (40). No youth come in but a lot of retired people do. Ms. Moermond asked what kind of entertainment they have there. Mr. Hanson explained that one night each week, they have karaoke. They also have a pull tab booth and a meat raffle on Saturday aftemoons from 1-4 pm. Lady Slipper charity runs their pull tabs and will probably bring back the big wheel. Lady Slipper gives away a lot of scholazships. Ms. Moermond asked if they have a smoking area. Mr. Hanson responded that peopie go outside to smoke; there's no special area. Ms. Moermond asked about the history of tkus baz. Ms. Natus responded that she owned that bar when it was called Diamond Lynn's Saloon. She and her husband took it from a very troublesome bar with a lot of issues to a cleaned-up bar with no issues. Their clientele was older and they didn't have to worry about fights, etc. They owned it for six (6) years and it was very successful. Then, they sold it to Scooters. Now, she and her husband are working with Greg and Pam to guide them during this transition. Ms. Natus explained that she is vice president of the North End Business Association but has not yet talked with the District Six Planning Council or Councilmember Lee Helgen. But, as vice president of the Association, she is awaze of their endeavors and she thinks Greg and Pam Hanson would be an asset to that bar and that neighborhood. Ms. Natus and her husband currently own Hammernick Decorating on Rice Street and it is nice to see something positive happening in that North End neighborhood. Both she and her husband are working very hard to get more businesses into the neighborhood, keep the neighborhood cleaned-up, and keep track of what's going on. They are both on the task force and wark with the Police Department frequently. She said that she would not be at this hearing if she did not think this couple could do a good job. Beaver's Bar, formerly across the street (license revoked) had many problems and some of their issues had been inappropriately attributed to clientele at Scooters. The letter of concern that ihe City received addressed concerns that related to this former bar while it was open (1999 — 20�1). Ms. Moermond recommended approval without conditions.
