WHEREAS, Edward R. Moore, an employe of the
Department of Public Safety, Bureau of Police, was injured
in a third party accident August 7, 1955, involving also
one Joseph Giefer, and the City has expended on behalf of
its employe the sum of $107.30 in medical expense and the
employe was disabled on account of said accident for a period
of time, being paid salary in the sum of $271.24 therefor,
or a total expenditure of $378.54; and
WHEREAS, A settlement has been arrived at between
the employe and the other party involved in said accident,
in the total sum of $ 5000 , and the employe, through his
attorney Mr. John Daubney, has offered the sum of $200 in
settlement of the City's subrogation claim for injury to its
employe, and the office of the Corporation Counsel recommends
settlement of the City's claim in such amount, in view of
the seriousness of employee's injuries and the amount of
total settlement, now, therefore, be it r.
RESOLVED, That the proper city officers are hereby
authorized to accept the sum of $200.00 in full, final and
complete-settlement of the City's subrogation claim for
medical expense and salary expended on behalf of its employe
on account of said third party accident, and to sign any
necessary releases; that of said sum, the amount of $107':30
shall be credited to Fund 31 G1 A, and the amount of $192.70
be credited to the police salary fund.
