WHEREAS, the City of Saint Paul and the Housing and Redevelopment
Authority of the City of Saint Paul propose to enter into an amendment
to a contract dated March 15, 1962, whereby the City of Saint Paul under-
took to perform design services for the parks in the Eastern Redevelop-
ment Project, U.R. Minn. 1 -1, and the Western Redevelopment Project,
U.R. Minn. 1 -2, for a designated compensation; and
WHEREAS, it has now been determined that the City, under a pro-
posed amendment to said contract, i-s to receive the total amount of
$5,10+.92; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
ratifies, approves, and adopts said contract of March 15, 1962, and
the proposed amendment thereto, a copy of which is attached hereto,
marked "Exhibit A" and made a part hereof by reference, and hereby
authorizes and directs the proper City officers to execute, on behalf
of said City, the aforesaid amendatory agreement to said Design
Services contract.

m THIS AGREEMENT, made this __2' day of , 1963, by and between
HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT PAUL,
MINNESOTA, (herein called the "Authority "),
and
the CITY OF SAINT PAUL, MINNESOTA, (herein called the "City ").
WITNESSETH:
WHEREAS, the Authority and the City entered into a Design Services Contract
dated March 15, 1962, providing for the performance of certain technical and
professional services in connection with the design and construction of parks
within the Eastern Redevelopment Project U.R. Minn. 1 -1 and the Western
Redevelopment Project U.R. Minn. 1 -2, located in the City of Saint Paul,
County of Ramsey, and State of Minnesota, with compensation therefore fixed
at 105% of the salaries of certain designated personnel for the time such
employees were engaged in providing the services therein provided for together
with the reproduction costs of materials expended, not to exceed 3% of actual
construction cost of $3,500.00 whichever was the greater; and
WHEREAS, under the terms of Paragraph 17a of said Contract, in the event,
at any time during the performance of said Contract, it appeared that the cost
of the services to be performed would exceed the maximum compensation provided
for in the Contract, the City was to notify the Authority of such fact and submit
a statement of work and services performed and materials provided and an estimate
of all additional services and materials necessary to complete performance of the
Contract on the part of the City, whereupon the Authority could consider and

propose an Amendment*to said Contract revising the amount of total payment by
the Authority under said Contract; and
WHEREAS, the City has submitted to the Authority that costs would exceed
the maximum payments provided under the Contract together with the statement
required under Paragraph 17a and the Authority has considered the same and
proposed an Amendment to the Contract which will provide for payment by the
Authority to the City of the total amount of $5,104.92 as full and final com-
pensation for all services to be performed and materials to be provided under
the aforesaid Design Services Contract. +
NOW THEREFORE, the parties hereto do mutually agree that the Design
Services Contract dated March 15, 1962, is amended to provide as follows:
That the total compensation payable by the Authority to the City
for all work and services performed, and for all materials supplied
under this Contract shall be the sum of $5,104. "92 and no greater
amount.
IN WITNESS WHEREOF, the Authority and the City have executed this Agreement
as of the date first above written.
