C : ' c L y . ouncil File No. 212260 —:By Milton NO OFFICE OF THE ^RiniGi;n} ^navy's, 195s; under C U CIL RESOLUTION �ENERAL"- � ,:a I.ISfiED PRESENTED BY -1 COMMISSIONE DATE WHEREAS, on January 6, 1959, under Council File No. 19o477, the City Council officially opened Wheeler Street to a width of 66 feet from Thomas Avenue to the southwesterly line of Lot E, Dickerman's Rearrangement; and 1 WHEREAS, on August 14, 1962, the Council took further � action in regard to Wheeler Street by passing Final Order No. 208598, a final order ordering the grading and surfacing with bituminous material of Wheeler Street from Thomas Avenue to a point 341.4 feet south of Thomas Avenue, which generally „ speaking encompasses the same area* as the opening order; and WHEREAS, prior to the holding of this final hearing sometime in the fall of 1961, the City of Saint Paul requested and obtained a hearing before the Railroad and Warehouse Commission of the Std of Minnesota; and WHEREAS, a hearing was held as to the advisability of allowing a crossing across the Minnesota Transfer Railway Company's tracks at this point; and on January 24, 1962, the Office of the Corporation Counsel received the opinion of said Railroad and Warehouse Commission allowing this crossing with certain provisions; and WHEREAS,-- the'_Pu.blic- WorkCDepartment o`f ' the" City of Saint Paul is now about to let a contract to do the above mentioned construction work; and before the he_4ri:ngs, estimates 'were obtained from the Chief Engineer of the Minnesota Tran.pfer Railway Company as to the costs of certain track�c�anges- and switch moves. which would be necessitated by this op,e ing and gr1ading 'of-Wheeler Street; and WHEREAS, the City tngineer of the City of'-Saint Paul has reached a tentative agrgement with'the'Minnesota Transfer Railway Company whereby said railway - company, in .cooperation with the City's change of grade and grading over said company's tracks , will make certain track and switch changes and warning signal installations which will facilitate the work to be carved out by the City of Saint Paul; and COUNCILMEN Yeas Nays Dalglish Holland Loss Mortinson Peterson Rosen Mr. President, Vavoulis .J 10A1 8-82 Tn Favor Against Adopted by the Council 19— Approved 19— _ r Mayor (f�j, "j�qe (1 ORIGINAL TO CITY CLERK ' f� '••'rp'2 1 CITY OF ST. OFFICE OF THE CITY CLERK FILE COUNCIL RESOLUTION - GENERAL FORM PRESENTED BY COMMISSIONER DA KA WHEREAS, it has been tentatively agreed that upon submission to the City Engineer of a voucher for work to,be done for said Railway Company,the City is to reimburse the Railway Company for the cost of such work, such amount in no event to exceed the sum of 1,600.00; now, therefore, be it RESOLVED, by the Council of the City of Saint Paul, that this Council hereby authorizes the proper City officers to pay to the Minnesota Transfer Railway Company its costs in connection with the Wheeler Street grade change and grading in the area where Wheeler - Street will cross said company's tracks north of University Avenue in the City of Saint Paul, upon receipt by the City Engineer of an itemized statement from said company as to its expenditures 'in connection with such work, as aforesaid, and upon the City Engineer indicating by letter to the Comptroller's Office and to the said railway company that the work has been completed to his satisfaction; be it FURTHER RESOLVED, that the amount of such reimbursement to the railway company is not to exceed the amount of the actual cost to - said railway company or the sum of $1,600.00, whichever is greater.
