RESOLVED, pursuant to the pertinent appeal under the Zoning
Code, by F. F. Foslien Homes, Inc., as owner of the subject-premises
situate in the City of Saint Paul, that the provisions of said Zoning
Code hereby are determined and varied to the extent necessary therefor
and a 40 -foot building line setback, in respect of the west line of
Westminster Street, a 20 -foot building line setback from the east line
of the service road of Highway No. 35E, and a 55 -foot building line set-
back from the south line of Clear Avenue, upon which the same abut,
hereby are established for said premises, particularly described as:
Subject to part taken for highway, the northeast 1/4
of Lot 19 and subject to Westminster Street, the
north 1/2 of Lot 20, all in J. W. Bass Garden Lots;
and that, pursuant to the pertinent application of said F. F. Foslien
Homes, Inc., a permit hereby is granted to said applicant to establish,
maintain, and operate a 108 car capacity special purpose off - street
parking facility on said premises in conjunction with the six 17 -unit
apartment buildings presently proposed to be constructed thereon.
RESOLVED FURTHER, that said special purpose off - street parking
facility shall be established and maintained in substantial conformity
to the approved plans therefor, a copy whereof is herewith filed, and
in compliance with all applicable provisions of State and municipal laws.

This is in the matter of the F. F. FoslZen Homes Inc. 1) appeal to establish
a 40 foot- h1117�� ine se�tb ;ck from Westminster Street, a 20 foot building

unimproved Clear Avenue, and 2) an application fo�''"r a permit_,for a car par -
ing lot in con,7unc ion w six 17 -unit apartment buildings to be erected on
property located on the south side of unimproved Clear Avenue from Westminster
Street and the Service Road of Highway #35E. The subject property is described
as subject to part taken for Highway, the northeast one - quarter of Lot 19 and
subject to Westminster Street, the north one -half of Lot 20, all being in
J. W. Bass Garden Lots.
The subject property was rezoned to "C" residence in two separate tracts, the
major portion on August 11, 1962 and the balance on September 29, 1962. The
site is vacant and has a frontage of 443 feet on the west side of Westminster
Street and on tbO east side of #35E Service Road and 425.74 feet on the south -
side of unimproved Clear Avenue resulting in an area of approximately 188,603
square feet. North and across unimproved Clear Avenue is vacant land classified
in the "A" residence district; west and across the Service Road is Highway # 35E;
east and across Westminster Street is agricultural land and one singlefamily
residence; south and adjoining are several single - family residences which
front on Westminster Street, also vacant land which fronts on #35E Service Road.
Because this property extends between two streets for a distance of approximately
426 feet, it is necessary that the applicant establish a building line other
than that which would be required under the Zoning Code (85 feet). Therefore,
he is requesting that a 40 foot building line setback from'Westminster Street
be established for the purpose of permitting the off - street parking to be within
20 feet of Westminster Street; that a 20 foot building line setback be estab-
lished from Highway # 35g Service Road to permit thecff- street parking to be
within 10 feet of the street line, and that 55 foot building line setback be
established from the street line of Clear Avenue. Field investigation discloses
no objection to either the requested building line setbacks or the proposed
parking facility. The Traffic Engineer has approved the plan which meets the
standards for.this type of facility. The proposal meets the standards for
building ground coverage liberally and exceeds the required density standards.
In consideration of the above factors, the Board of Zoning recommends 1) the
granting of the appeal to establish the building line setbacks as outlined
above, and 2) the granting of the permit for a 104-car private off - street
parking facility on the abovQ, described property i accordance with plans '
approved March 21, 1963. W

On October 10, 19621 I filed for a variance in the zoning code (and paid
the $20.00 fee for such request), which has been held in abeyance at my
request. I am now requesting to amend my original appeal as follows:
Please establish a minimum building line set -back of 401 along the west
side of Westminister Street, and a minimum building line set- -back along
the east side of Highway 35E Service Road- of 201*.
The legal description of the property is: The North one -half of Lot
Twenty, except the South five feet thereof, and except that part taken
for Vestminister 'Street; and the North one -half of the East one -half of
Lot Nineteen, except the South five feet- Mereof and except the West'39.7'
for Service Road, J. W. Bass Garden Lots.
This is a large tract of land having frontage of 443' along the west side
of Westminister Street,as platted, and along the east side of Highway 35E
Service Road. The proposal is to develop this site with six 17 -unit a-
partment buildings.
We are making this request under Section 64.03, Paragraph J of the Zoning
Code as the requirements of Chapter 62 dealing with set -back requirements.
It would require a normal set -back from Westminister Street of approximately
60' and set -back of approximately 25' from Highway 35E Service Road.
