REZONING OF CERTAIN PROPERTIES IN THE
CITY OF SAINT PAUL, AS AMENDED. ',..THIS IS
AN EMERGENCY ORDINANCE RENDERED=- NECESSARY
FOR THE PRESERVATION OF THE PUBLIC PEACE,
HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of
certain properties in the City of Saint Paul, as amended,
be and the same is hereby - ,further amended so as to rezcn e
the following described property from "B” Residence District
to "C" Residence District, to -wit:
Lots 1 through 15 and the east 20 feet of
Lot 16, also the east one -half of vacated
alley adjacent to Lots 1 through 12 and all
of vacated alley adjacent to Lots 13 through
15 and the east one- halfcf Lot 16, all being
in Block 1, Schletti Second Addition, accord-
ing to the plat thereof on file and of record
in the office of the Register of Deeds in and
for Ramsey County, Minnesota, being located
on the west side of Virginia Street and extend-
ing from Maryland Avenue to Orange Avenue.
Section 2. This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and publication.

Dear Madam:
This is in the matter of the petition of Carl J. Conney and Peter E. Fooshe Jr.
to rezone from "B" to "C" residence property located on the west side of
Virginia Street and extending from Maryland Avenue to Orange Avenue which
is described as Lots 1 thru 15 and the east 20 feet of Lot 16, also the east
one -half of vacated alley adjacent to Lots 1 thru 12 and all of vacated alley
adjacent to Lots 13 thru 15 and the east one -half of Lot 16, all being in
Block 1, Schletti 2nd Addition.
On March 6, 1963, the Commissioner of Finance reported the petition sufficient
with the owners of 34 of a possible 34 (1007o) tracts of land within the pre-
scribed 100 foot radius having signed the petition. The site is vacant and
the portion fronting on Virginia Street is approximately four feet below the
street grade. However, that part which fronts on Maryland Avenue is level
and at street grade. The petition indicates that the site will be developed
,,,,for apartment use, but no specifie'proposal was submitted. The subject pro-
perty consists of several platted lots having a combined frontage of 596.94
feet along the west side of Virginia Street and extending to a depth of
131.9 feet. The subject property also has a frontage of 130.31 feet along
the north side of Maryland Avenue resulting in a total land area of approxi-
mately 78,523 square feet.
To the north and west adjoining is commercially zoned land which is used for
growing nursery stock; east and across Virginia Street are several single-
family residences and several vacant lots zoned "B" residence; south and
across Maryland Avenue are single- family residences fronting on Virginia
Street zoned "B" residence; to the west and adjoining and fronting on Mary-
land Avenue is a nursery retail sales office the zoning of which is commercial.

The Board of Zoning considered this matter at their regular meeting on
March 21, 1963 and because of the soil conditions prevalent in the area,
felt that the area would not be developed except for apartment, use. There-
fore, the Board of Zoning recommends the granting of the petition to rezone
the above described property to a "C" residence district.
