This property is legally described as follows, to wit: CHELSEA HEIGHTS LOT 9 BLK 4 ]0 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before March 31, 2007, the following are the now known interested or responsible parties for the Subject Property: Bjorn J Ulstad/Karen M Ulstad, 1010 Chippewa Ave, Mendota Heights, MN 55118; US Bank N.A. ND, P.O. Box 6363, Fargo, ND 58125; Como Community Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated August 21, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by September 20, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been conected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Heazing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paui Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, November 27, 2007 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by 0 7-/��g 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 rehabilitating this structure in accardance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within one hundred and eighty (180) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, December 19, 2007 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order conceming the Subject Property at 1587 HURON STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ••� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accardance with all applicable codes and ordinances, or in the alternative by demolishing D�-��-a�-8 87 88 89 90 91 92 93 94 95 96 97 98 99 ]00 101 102 103 104 and removing the structure in accordance with all applicable codes and ordinances. The rehabilitatfon or demolition and removal ofthe structure must be completed within one hundred and eighty (180) days after the date of the Council Hearing. 2. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and chazge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. Ordering the owner to remove or repair the building(s) at 1587 Huron Street within fifteen (15) days from adoprion of resolution. The property owner of record, Karen Ulstad, appeazed. Ms. Moermond asked whether Bjorn Ulstad was her husband. Ms. Ulstad stated that her husband was deceased. Mr. Magner stated the building was a one-story, brick, single-family dwelling with a detached one car garage on a lot of 5,227 square feet and had been vacant since March 27, 2002. A code compliance inspection had been done on March 27, 2002. The vacant building registration fees were current and the $5,000 performance bond had been posted on October 1, 2007. On August 8, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on August 21, 2007 with a compliance date of September 20, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value ofthe land to be approximately $69,700 and the building to be $138,900. Real estate tazces were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $8,100 to $11,000. There was one summary abatement issued to this property since 2002 which did not go to work order. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moerxnond stated that most of the items that she normally requested to be done had already been taken care of by Ms. Ulstad. She asked if she had formalized a plan for rehabbing the property. Ms. Ulstad stated that she planned to rehabilitate the property and reoccupy the property herself. Ms. Moermond asked Ms. Ulstad where she was presently living. Ms. Ulstad stated that she was currently living on Chippewa Avenue in Mendota Heights. Ms. Moermond asked what progress had been made so far on repairing the building. Ms. Ulstad responded that the house had been re-roofed, the exterior trim had been painted, the garage had been repaired, all exterior trim that needed to be replaced had been done, and she planned to replace the windows. Ms. Moermond asked Ms. Ulstad whether she owned the house. Ms. LTlstad responded that she did own it. Ms. Moermond asked Ms. Ulstad whether she refinanced the property to afford the cost of the rehabilitation. Ms. Ulstad stated that she had a home equity loan on the house; however, was using funds that she now had available that she had put into her bank account. Ms. Moermond asked Ms. Ulstad if she was working with a general contractor. Ms. Ulstad responded that she was not at this point in time. She had hired a contractor to work on the exteriar and needed to find someone to work with on the interior of the home. Ms. Moermond stated that she would need the following documentation in order to recommend to the City Council that they grant 180 days to complete the repairs: 1) a work plan prepared in accordance with the code compliance inspection report ouflining the repairs and the cost of the repairs; and 2) financial documentation indicating that there was adequate funds in arder to complete the repairs. Code Enforcement indicated that the estimated cost of the repairs was November 27, 2007 Legislative Hearing Minutes Page 15 b7�/?��$ between $50,000 to $60,000 and she would need to show that she had at least this amount of funds auailable. Ms. Moermond recommended continuing the hearing to December 11. Ms. LTlstad stated that she did have her bank account information with her which she could provide for Ms. Moermond. Ms. Moermond stated that she had reviewed the work plan and bids that Ms. Ulstad had faxed on December 7 and believed everything was in order. Ms. Moermond stated that she had reviewed the financial statement that Ms. Ulstad had presented at the November 27 Legislative Hearing. The statement indicated that Ms. Ulstad had substantial funds to be able to complete the repairs to the building. Mr. Magner stated that he had reviewed the work plan, bids and the financial statement and he recommended granting 180 days to repair the building. Ms. Moermond recommended granting 180 days to complete the repairs to the building.
