1 WIIEREAS, a request has been received from Christiansen, Laue & Rasmus, P.A., on behalf of the owner of

3 BUSINESS CENTER, Ramsey County, Minnesota, for the release of a public utility easement within vacated
4 Desoto Street between Whitail Street and Phalen Boulevard, described more particulazly as:

6 That part of Desoto Street, Zying between Blocks 4 and 5, STINSON'S ADDITION TO THE C77Y OF
7 SAINT PAUL, Ramsey County, Minnesota, lying North of a line between the southeast corner of Lot 16,
8 said Block 5 and the southwest corner of Lot 1 S, said Block 4 and lying South of a line from the
9 northeast corner of said Block 5 to the northwest corner of said Block 4; and

WHEREAS, said easement rights were reserved as to Parce18, as described and referenced in Council File No.
04-498, recorded in Ramsey County as Doc. No 1836106 (Tonens) and Doc. No. 3820517 (Abstract); and
WHEREA5, the facility for which said easement rights were reserved no longer exists within said easement
area; now, therefore be it
RESOLVED, that with the accompanying utility easement Certificate of Intended Non-Use, filed voluntarily on
behalf of Northern States Power Company, d/b/a Xcel Energy, attached hereto and made a part hereof by this
reference, and filed in the office of the City Clerk of Saint Paul, the City, on behalf of said utility company,
hereby waives and releases all rights to said public utility easement; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a$300.00 administrative fee, the
proper city officials are hereby authorized to provide the attorney for 455 Phalen Boulevard a certified copy of
the resolution for recording in the Offices of the Ramsey County Recorder and Ramsey County Registrar of
Titles.
