WHEREAS, under Project No. 61 -M -184, Contract No. L- 6176 -8,
which contract provides for the construction of the Summit-Ave.
Bridge over the Short Line Road and the tracks of the Chicago,
Milwaukee, St. Paul and Pacific Railway, Ashbach Construction
Co., being the Contractor described in said Contract, an extended
completion date has been set forth, as authorized by C.F. 2090882 f
approved Sept. 14, 1962, which date is Nov.71, 1962, and
WHEREAS, some work is still to be completed during the con-
struction period of 1963; and
WHEREAS, there is no showing of extenuating circumstances }
causing a failure to complete said project under the terms of the t
aforesaid contract by the said extended completion date; and
WHEREAS, pursuant to said contract, the City of St. Paul may
proceed against said Contractor for liquidated damages in the
amount of $25 per day for each calender day following the con-
tracted -for date of completion and payment of costs for inspect-
ion occurring after said contemplated completion date; and
WHEREAS.' it i-s� the recommendation of the Commissioner and
Chief Engineer of the Department of Public Works, that the
City waive said liquidated damages of $25 per day upon payment
by said Contractor-of the`sum of $628.80, the same being the
reasonable inspection costs based on time sheets which are a
part of the permanent records of said Public Works Department,

RESOLVED, that the completion date of said Contract may
be and hereby is extended from Nov. 1, 1962 to May 15, 1963s
and that said City does hereby waive its liquidated damages
in the amount of $25 per day contingent upon payment by said
Ashhach Construction Co., the aforesaid Contractor, of the sum
of $628.80, the same representing reasonable inspection costs
incurred by virtue of the failure to complete said project on,
or before the stipulated completion date, as previously'ex-
tended, and
RESOLVED FURTHER, that appropriate City Officers are here-
by directed to prepare the necessary documents and forms to
effectuate the purposes of this resolution, and further that
the proper City Officers are directed to accept such sums and
to make such disbursements as shall be contingent with and
authorized by this Resolution and the purposes thereof.-
