provisions of said Zoning Code hereby are determined and varied as and

The City Council requested that you draw a resolution
granting the appeal of Arvid Nelson for the establishment of a
zero (0) foot building line from Cook Avenue on Lots 14 and 15, Block 7,
Arlington Hills Addition, located at the Southeast corner of Cook and
Payne, subject to the condition that any building to be constructed
thereon shall not exceed one story in height.

Dear Madam:
This is in the matter of the appeal of Arvid Nelson to establish a
zero (0) foot building line from Cook Avenue on property located at
the southeast corner of Cook and Payne Avenues which is described
as Lots 14 and 15, Block 7, Arlington Hills Addition. The zoning
of the property is commercial.
The subject property is developed with an abandoned filling station
which was remodeled in 1953. The applicant proposes to relocate his
boat sales and service and automobile repair business now situated on
York and Payne Avenues on the subject property. His proposal includes
a one -story addition to the north side of the existing structure which
would result in a building line setback of zero (0) feet on the south
side of Cook Avenue. The existing structure maintains a setback of
approximately 51 feet. The adjoining property to the east,whicb is at
a higher elevation because of the grade of Cook Avenue, is developed
with a single - family residence which maintains a setback of ten -feet
from Cook Avenue, the second residence to the east also maintains a ten -
foot setback. The commercial properties at the other three corners of
this intersection maintain a zero foot setback from Cook Avenue, either
because of a difference in the platting or the fact that they were con-
structed prior to the enactment of the Zoning Code. The subject property
has a frontage of 79 feet on the south side of Cook Avenue and 125 feet
on the east side of Payne Avenue, resulting in an area of 9,875 square
feet.
Field investigation discloses that the proposed addition should maintain
a minimum setback of at least 10 feet from Cook Avenue to prevent a
detrimental effect on the adjoining property to the east.
In consideration of the above factors, the Board of Zoning recommends the
denial of the request to establish a zero (0) foot setback and recommends
the establishment of a ten -foot setback from Cook Avenue on the above
described property.

Our names are Arvid Nelson and Maxine Nelson. We have recorded in our
names, lots 14 and 15, block 7, ward 1 of Arlington Hills Addition to St.
Paul, located on the S.E. corner of Payne Ave. and Cook St.
We pruchased this property from the Shell Oil Co.. It had been used for
a gasoline station. The gas tanks will be removed as they will not be used
in our business which is repairing motor's and selling fishing boats.
We wish to add to the present building a show room and warehouse for
our boats and motors. We will retain the present building as a service
shop.
The purpose of our applal is to establish a Zero building line on Cook
St. We fefer to Legislative Code, chapter 6403, paragraph J. The other
three corners on Payne and Cook have Zero building lines.
The lot adjoining our property to the East is also a Commercial lot.
We urgently need the ten or twelve feet on Cook'Street. Our new building
would be too small without this area. The size of the off street parking
area is also urgently needed.
We are at the present time located on the N.E. corner of York and Payne
Ave. (902 -904), and have been doing business here as Nelson Motor Service
for the past thirty one years. Our reason for moving is that we need the
off street parking for our business.
