ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates five or more lots or parcefs each of which is 2'/Z acres or tess in size, or (2) requires paved streets, afleys and other public improvements, or (3) is previously unpiatted land. §69.406 provides criteria for review ot subdivision applications. These criteria are covered below under "Required Findings." F. HISTORY/DISCUSSION: The site has been subdivided twice previously, in 1983 and 1984 (Subd. File #s 59 and 91). The 1984 subdivision created 4 parceis. Two of the parcels were developed with restaurants (Parcel 1 as a Chi Chi's restaurant and Parcel 2 as a Hardee's fast food restaurant}, while Parcels 3 and 4 remained vacant. The area genera4ly encompassed by Parcels 1 and 3 is the subject of the current application. Site plans have been approved for Flannery Construction Headquarters and parking along St. Anthony Avenue (File #s 05-076378 and 07-045788) and for a new West District police station (File # 07-030549). G. DISTRICT COUNCIL RECOMMENDATION: District 13 had not commented at the time this staff report was prepared. H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that afl of the foilowing findings shall be made prior to approvai of a subdivision: 1. AU the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed plat and have determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be defrimental to the present and potentiai sur�ounding land uses. The proposed ptat is consistent wfth the surrounding land uses, and wili not be detrimentai to present and future use of surrounding land. 3. The a�ea surrounding the subdivision can be planned and deve%ped in coordination and compatibility with the proposed subdivision. The subdivision is in conformance with the Land Use chapter of the comprehensive plan, which cails for redevelopment of sites with good freeway access. The site is at a freeway exit and freeway entrances are nearby at Snelling Avenue. !t is also in conformance with redevelopment plans for the area. 5. The subdivision preserves and incorporates the site's important existing natura( features whenever possible. The site is in a fully-developed part of St. Paul with no remaining natural features. 6. AI! land intended for building sites can be used safely without endangering residents by peril from floods, erosion, continuously ftigh water table, severe soil conditions or ofher menace. The sife is a flat, fully developed area with no flooding, erosion, high water table or soil condition problems. 7. The subdivision can be economically served with public facilities and services. The subdivision can be economicaily served with public facilities and services from surrounding streets. 1. PARKLAND DEDICATION: This appiication was received and started its review before the parkland dedication ordinance went into effect. Therefore no parkland dedication is required. J.
