RESOLVED, that upon appeal of John E. Daubney from the decision
of the Commissioner of Parks and Recreation and Public Buildings, a 35 -foot
building line is hereby established onithe following described property
situate on the south side of Colvin Avenue west of Hilltop Lane: I
All that part of Lots 15 and 16, Edgcumbe Heights, according
to the recorded plat thereof filed of record in the office of
the Register of Deeds in and for Ramsey County, Minnesota
described as follows: beginning at a point on the North
line of said Lot 16, 30 feet west of the northeast corner
thereof, thence South parallel to the east line of Lot 16
a distance of 66' feet, thence southwesterly a distance of
132.55 feet to a point 60 feet west of said east line and
60 feet north of the south line of Lot 16, thence south
parallel to said east line a distance of-30 feet, thence
west parallel to the south line of Lot 16 a distance of 90
feet, thence south parallel to the east line of Lot 16 a
distance of 30 feet to the south line of Lot 16, thence
west 30 feet along the south line of Lot 16 to the southwest
corner of Lot 16, thence northeasterly a distance of 156.85
feet to a point in Lot 15, said point being 82 feet south -
eas�erly of the northwesterly line of Lot 15 and measured

This is in the matter of the appeal of John E. Daubney to establish
a 35 foot building line setback on property located on the south
side of Colvin Avenue west of Hilltop Lane. The present setback re-
quirement for this property is 45 feet and therefore requires Council
authorization to establish the 35 foot setback requested. The legal
description is by meets and bounds, a copy of which is attached. The
zoning of the property is "Ail residence.
The site is irregular in shape and is approximately level and at the
street grade of Colvin Avenue for a distance of 140 feet from said
street, and then becomes an extremely steep embankment with its
lowest point approximately 40 feet below the street grade of Colvin
Avenue. The subject property has a frontage of approximately 132
feet on the south side of Colvin Avenue and extends to a depth of
approximately 225 feet.
Field investigation discloses that the surrounding area land uses are
very substantial single- family residences. The adjoining properties
to the east and west maintain setbacks of approximately 61 feet.
However, these owners have agreed to the proposed 35 foot setback in
writing.
The Board of Zoning considered this matter at their regular meeting
on April 25, 1963, and are of the opinion that the request is a
reasonable one. Therefore, the Board of Zoning recommends the grant-
ing of the appeal to establish a 35 foot building line setback on
the above described property.

top Lane, to -wit:

permitted, because otherwise the house would have to be built below the crest
of the hill. This appeal is made pursuant to Chapter 64.03 of the St. Paul
Legislative Code, Paragraph J.
