NECESSARY FOR THE,PRESERVATION OF THE
PUBLIC PEACE, HEALTH, AND SAFETY.
r THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of cer-
tain properties in the City of Saint Paul, as amended, be
and the same is hereby further amended so as to rezone the
following described.property from "C" Residence District to
Commercial District, to -wit:
Lot 1, Block 4, Syndicate No. 1 Addition,
according to the plat thereof on file and
of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota,
being located on the southwest corner of
Avon Street and Sherburne Avenue;
subject to the following express exceptions and conditions:
.1. That, subject to any further reclassifica-
tion of the hereinabove described real estate by
virtue of proceedings therefor hereafter instituted,
conducted and completed according to applicable pro-
visions of said Zoning Gode, as amended, and appli-
cable provisions of the statutes of the State of
Minnesota, hereby, the employment of said real
estate henceforth is restricted and limited to the
following specified uses, to -wits, (a) Residential
District uses permitted by the regulatory provisions
of the said Zoning Code, as amended, in A" Residence
District, "B" Residence District, and - "C" Residence
District, thereby established, and (b) Commercial
Uses which shall include no more than the establish-
ment, maintenance and conduct of a hair dressing and

2. That the owner of said real estate, within
the period of 60 days next succeeding the publica-
tion of this ordinance, shall file with the City
Clerk, in two fully executed counterparts, said
owner's written acceptance of this ordinance, in-
corporating, among other things, said owner's grant
unto said City of Saint Paul of a negative easement
effecting said real estate, for the imposition,
maintenance and enforcement of the aforesaid re-
strictions and limitations upon the employment and
use of the hereinabove described real estate, ap-
proved as to form and execution by the Corporation
Counsel and recordable in the office of the Register
of Deeds. That said owner's written acceptance by
apt provisions further shall obligate said owner and
the assigns of said owner in regard to said real
estate, to effectively consent to the rezoning of
said real estate to *C*' Residence District, upon the
'resolution of said Council requesting the same, in
the event of the cessation for a continuous period
of twelve months, of the use of said premises for
said permitted single commercial purpose.
3. That, in addition to other requirements
therefor, said written instrument of acceptance shall
incorporate a certified copy of this ordinance, and
immediately upon the aforesaid filing of the same the
City Clerk shall cause one of such counterparts thereof
to be filed of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota.
Section 2. This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

Dear Madam:
This is in the matter of the petition of Helen M. Prinz to rezone from
"C" residence to commercial property located at the southwest corner
of Avon Street and Sherburne Avenue which is described as Lot 1,
Block 4, Syndicate Addition # 1.
On April 5, 1963, the Commissioner of Finance reported the petition
sufficient with the owners of 12 of a possible 15 (80°jo) tracts of
land within the prescribed 100 foot radius having signed -the petition.
The site is developed with a two - family residence which fronts on
Avon Street, and it is proposed to install and operate a beauty shop
in one of the units as indicated on the petition. The subject pro-
perty has a frontage of 40 feet on the south side of Sherburne Avenue
and 100 feet on the west side of Avon Street, resulting in an area
of 4,000 square feet. To the west and adjoining for the remaining
part of the block are single and two - family residences; north and
across Sherburne Avenue are single- family residences fronting on
said street; east and across Avon Street is an apartment building
fronting on Sherburne Avenue; to the south and across a public alley
is a used car sales lot which fronts on University Avenue.
The Board of Zoning considered this matter at their regular meeting
on April 25, 1963, and recommends the granting of the petition to
rezone the above described property subject to a negative easement
limiting the commercial use to that of a beauty shop.

Code, Chapters 60 tq 64, inclusive, of
the Sairlt Paul Legislative Code, per=
taining to Use Districts, H e i h t
Districts and Rezoning of certain
properties in the City of Saint Paul;
as amended. This is an emergency
ordinance rendered necessary for the
preservation of the public peace,
health, and safety-
The Council of the City of Saint Paul
Does Ordain:
SECTION 1
That the Zoning Code, Chapters 60
to 64, inclusive, of the Saint Paul
Legislativg Code, pertaining to U s e
Districts, Height Districts, and Rezon-
ing of certain properties in the City
of Saint Paul, as amended, be and the
same is hereby further amended so as
to rezone the following described
property from "C' Residence District
to Commercial District, to -wit:
Lot 1, Block 4, Syndicate No. 1
Addition, according to the plat
thereof on file and of record in the
office of the Register of Deeds in
and for Ramsey County, Minne-
sota, being located on the south-
west corner- of Avon Street and
Sherburne Avenue;
subject to the following express ex-
ceptions and conditions:
1.' That, - subject to any further
reclassification of the hereinabove
described real estate by virtue of
proceedings therefor hereafter in-
stituted, conducted and completed
according to applicable provisions of
said Zoning Code, as amended, and
the State of
henceforth is restricted and limited
to the following specified uses, to -'
wit: (a) Residential District uses
permitted by , the regulatory pprovi-

sions of the said Zoning Code, as
amentded, in "A" Residence District,
"B" Residence District, and "C"
Residence District, thereby estab-
lished, and (b) Commercial Uses
which shall include no more than
the establishment, maintenance and
conduct of a hair dressing and beauty
culture shop, subject to all applic-
able statutes, ordinances, rules and
regu lations prescribed and promul-
gated by governmental agencies
having cognizance, and without the
use or employment of any advertis-
ing sign or placard pertaining to
the same.
2. That the owner of said real
estate, within the period of 60 days 1
next succeeding the publication of
this ordinance, shall file with the
City Clerk, in two fully executed
counterparts, said owner's written
acceptance of this ordinance, incor-
porating, among other thing id f
owner's grant N,unto said City
Saint Paul of a negative easement
affecting said real estate, for the
imposition, maintenance and enforce-
ment of the aforesaid restrictions and
limitations upon the employment and
use of the hereinabove described
real estate, approved as to form and
execution by the Corporation Coun-
sel and, recordable in the Office of
the Register of Deeds. That said
owner's written acceptance by apt'
provisions further shall obligate said
owner and the assigns of said owner,
in regard to said real estate, to
effectively consent to the rezoning
of said real estate to "A" Residence
District, upon the resolution of said
Council regnesting the same, in the
event of the cessation for a con -'
tinuous period of twelve months, of
the use of said premises for said
permitted single commercial purpose.
3. That, in addition to o t h e r
requirements therefor, said written
'instrument of acceptance shall in-
corporate a certified copy of this
ordinance, and immediately upon the
aforesaid filing, of the same the
City Clerk shall cause one bf such
counterparts thereof to be filed of
record in the office of the Register
of Deeds in and for Ramsey County,
Minnesota.
SECTION 2
This ordinance is hereby declared to
be an emergency ordinance rendered
necessary for the preservation of the
public, peace, heath and safety.

This ordinance shall take effect and
be in force uponi its passage, approval
and publication.
