4 WHEREAS, this grant is a joint awazd for the Ciry of Saint Paul, City of Maplewood and the County of Ramsey,

6 WHEREAS, the Ciry Council authorized the City of Saint Paul to enter into the attached grant agreement on

Local Govemmencs, and Non-Profit Organizations, as further descnbed in the current edition of the 03P Financial
Guide, Chaprer i 9.
4. Recipient understands and agrees tha[ it canmt use any federal Ponds, either directly or indirectly, in support of Ihe
enachnent, repeal, modification or adoption of any law, regulation or policy, at any level of govemment, without the
express prior written approval of OJP.
5. The grantee agrees to assis[ 8TA in complying wi[h [he National Environmental Policy Act (NEPA) and other related
federal environmental impact anatyses requiremenls in the use of these grant funds, either directly by the grantee or by
a subgrantee. Acwrdingly, prior [o obligating Srant funds, the gan[ee agress to first determine if any of Ihe following
activiues will Se retated [o the use of the grant funds.
The grantee understands that this special mndition applies to its following new activities whether or not they are being
specificalty funded with thue grant funds. That is, as long as tk�e utivity is being conducted by the grantee, a
subgrentee, or any third party and the aciivity needs to be undertaken in order W use these grant funds, this speciat
wndition must fi�t be met. The activities covered by this special condition are:

b. Minor renova[ion or remodeling of a property either (a) listed on or eligible for listing on the National Regis[er of
Historic Places or (b) located within a 100-year flood plain;

d. Implementation ofa new program invotving fhe use oFchemicals other than chemicals tha[ are (a) purchased as an

6. This special condition facilitates compliance wi[h the provisions ofthe National Emironmental Policy Act (NEPA)
retating to clandesUne methamphetamine labora[ory operntions, including the identificafion, seizure, or closure of
ciandes[ine methamphetamine laboretories [hereinafteq "meth lab operahons"�. No monies trom this award may be
ob��gated to support meth lab operations unless the grantee imptements Ihis special condition.
The Office of Justice Progtams (OJP), in consul[ation with the Bureau of Justice Assistance, the Drug Enforcement
Administration, and tF�e O�ce for Commu�iTy Oriented Poticing Services, prepared a Proyrzam-tevel Environmental
Assessment (Assessment) goveming meth lab operations. The Assessment describes Ihe adverse emironmental,
heatth, and safery impac[s (ikely to be encountered by law enforcemen[ agencies as [hey implement specific actions
under their meChamphefamine laboratory operations. Consistent with ihe Assessment, the following terms and
cond�[ions shall apply [o the grnntee for any O1P funded methlab operatio�s:
A, The grantee shall ensure compfiance by O1P funded sub-grantees with federal, state, and local environmenta(,
health, and safety laws and regulations applicable to meth Iab operations, to include the disposal of the chemicals,
eqmpment, and wastes resulting ftom those operations.
B, The gran[ee shatl have a Mitigahon Pian in place [ha[ identifies and documen[s [he processes and poin[s of
accoun[ability within its state. This plan will be used to ensure that the adverse environmental, heatth, and saFety
impac[s delineated in the Assessment are mitigated m a manner wnsiste�t with ihe requirements of this condition.
C. 'Che grantee shaii monitor OJP Funded meth lab operations to ensure that they comply with the following nine
mitiga[ion measures identifed in Ihe Assessment and whose implementation �s addressed in the grantee's Mitiga[ion
Plan. These miti�ation measures must be included as special condi[ions in ali sub�ants: (See Part I[ of this special
condition)
7. 1. Provide medical screening of personnef assigned or to be assigned by [he grantee [o [he seizure or ciosure of
clandestine me[hamphetamine laboratories;
2. Provide Occupational SafeTy and Health Adminishation (OSHA) required initial and refresher training for law
enforcement o�cials and aIl other personne( assigned ro either the seizure or ciosure of clandestine methamphetamine
IabomWries'
3. As detertnined by their specified duties, equip the personnel with OSHA required pm[ective wear and other required
safety equipment;
4. Assign properly trained personnel to prepare a comprehensive contamination report on each seized/closed
taboralory;
5. Uti{ize quatified disposat personnel to remove atl chemicals atd associated glasswa�e, equipment, and contaminated
materials and was[es from Ihe site(s) of each seized laborarory;
6. Dispose of the chemicafs, equipmen[, and contaminated materisls and wastes at properly licensed disposal facilities
or, when allowab(e, at propeflY licensed recycling facilities;
7. Monitor the transport, disposal, and recycling components of subpaza�aphs numbered 5. and 6. immediately above
in order to ensure proper comptiance;
8. Have in piace and implement a written agreement with the responsible state environmenhal agency. This agreement
must provide that the responsible state environmental agency agrees to (i) timely e�aluate the environmental condi[ion
at and around the site of a clOSed clandestine Iaboratory and (ii) coordinate wi[h the responsibte pariy, property owner,
or others to ensure that any residual contamination is remediated, if deteanined necessary by the state environmental
agency and in accordance with existing state and federal requirements; and
9. Have in place and implement a written agreement with the responsible state or tocal service agencies to properly
respond to any minor, as defined by state law, at the site. This agreement must ensure �mmediate response by quatified
personnel who can (i) respond [o [he potentiai health needs of any minor at the site; (ii) take that minor into protective
custody unless the minor is criminalty involved in the meth Iab activities or is sub}ect io acresi for other criminal
viotations; (iii) ensure immediate medical testing for me�hamphetamine toxicity; and (iv) artange for any foilow-up
medical tests, examinatwns, or heal[h care made necessary as a result of inethamphefamine [oxicity. � u

9. To avoid duplica[ing existing nehvorks or IT systems in any initia¢ives Ponded by BJA for law enforcement infocmation
sharing systems which involve in[erstace connectivity behveen jurisdiction, such systems shall employ, W the extent
possible, ezisting networks as the communica[ion backbone to achieve interstate connectivity, unless the grantee can
demonstrate to the saGs£action oF BJA that this requirement wouid not be cost effectrve or woutd impair the
functionality of an exis4ng or proposed IT sys[em.
10. To support public safety andjustice infortna[ion sharing, OJP requires the grnntee to use the National Infortnation
Exchange Modei (NIEM) specifications and guidelines for [his paRiculaz gant Grantce shall Qublish and make
ava�lable without resMction all schemas generated as a result of this grnnt to the component registry as specified in the

the Wst fund (including any interest eamed) during the period of the granL Grant funds (incWding any interest eamed)
not expended by the end of the grant period must be retumed to fhe Bureau of Justice AssistanCe no later [han 90 days
after tlie end of the grant period, along with [he final submission of the Financial Status Report (SF-269).
I2. The grantee agrees to comply with atl reporting, data collection and evalua[ion requiremenks, as prescribed by the BJA
in the program guidance for the Justice Assistance Grant (!AG). Compliance with these requirements witl be
monitored by BJA.
13. The recipien[ agrees that any infortnation technofogy system funded or supported by OJP funds will comply with 28
C.F.R. Part 23, Criminal Intelligence Systems Operating Policies, ifOIP detertnines this regulation to be appticable.
Should OJP determine 28 C.P.R. Part 23 to be applicable, O1P may, at �ts discretion, perfoim audits of the system, as
per 28 CF.R. 23.20(g). Should any violation of 28 C.F.R. Part 23 occur, the recipient may be fined as per 42 U.S.C.
3789g(c)-(d). Recipient may not safisf'y such a fine with federal funds.
14. The ruipient agrees that all income generated as a direct result of this award shatl be deemed program income. All
Qrog[am income must be accounted foc and used for the pmposes under the wnditions applicable Por the use of funds
under tUis award, including the effutive edrtion of the O1P Financial Guide and, as applicable, either ( t) 28 C.F.R. part
66 or (2) 28 C.F.R part 70 and OMB C�rw(ar A-110. Further, the use of program income must be shown on the
quaRerly Financiat Status Report, SF269.
15. The recipient agrees to ensure that the State Infomiation Technology Point of Contact receives written notification
regarding any information [echnofogy project funded bY this gra�t dudng [he obligaaon and expenditure pedod. This is
ro facilitxte communicafion among Iocal and state govemmenral entiaes regarding various informatio� technology
p�ojects being conducted with these grant funds. In addi[ion, the recipient agrees [o maintain an administrative fiIe

All grants funded under the Edward Byme Memorial 7ustice Assistance Grant Program (JAG) will carry
the following NEPA special condition:
O The grantee agrees to assist BJA in complying with the Nationa! Environmenra! Policy Act (NEPA)
and other related federnl environmental impact analyses requirements in the use of these grant funds,
either directly by the grantee or by a subgrantee. According(y, prior to obligating gran[ funds, the grnntee
agrees to first determine if any of tUe following activities will be related to the use of the grant funds. The
grantee understands that this special condition applies to its following new activities whether or not [hey
are being specifically funded with these grant funds. That is, as long as the activity is being conducted by
the grantee, a subgrantee, or any third pariy and the activity needs to be undertaken in order to use these
grant funds, this special condition must first be met. The activities covered by this special condition are:
a. New construction;
b. Minor renovation or remodeling of a property either (a) listed on or eiigible for listing on the National
Regis[er of Historic Places or (b) located within a 100-year flood plain;
