1 WHEREAS, Chapter 293 of the Saint Paul Le�islative Code was enacted to re�ulate the subject of
z noise in the City of Saint Paul; and
G WHEREAS, §293.11 prQVides for the granting of variances from the sound level limitations

WHEREAS, the City of Saint PauPs Public Works Sewer UtiliYy, represented by Joseph Mueller,
Civil Engineer IV, who has been designated as the responsible person on the application, has applied for
a variance to operate equipment to repair the Saint Peter-Rondo Storm Tunnel at the following locations:
1) Chatsworth Street and Concordia Avenue; 2) Fisk Street and Concordia Avenue; 3) St. Albans Street
and St. Anthony Street; 4) Fuller Avenue and Grotto StreeY; 5) Edmund Avenue and Avon Street; and 6)
Victoria Street and Blair Avenue; and
WHEREAS, applicant is seeking a variance to operate 20 hours per day — from 5:00 a.m. to 1:00
a.m., from January 8, 2007 to Apri130, 2007; and
WHEREAS, if applicant is not granted a variance it will not be able to operate equipment to repair
the Saint Peter-Rondo Storm Tunnel; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the
application and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the City of
Saint Paul's Public Works Sewer Utility, subject to the following conditions:
1) The variance shall be for 20 hours per day — from 5�00 a.m. to ]:00 a.m., from Jamtary 8, 2007
to Apri130, 2007.
2) The City of Saint PauPs Public Works Sewer Utility shall take all practical steps available to
minimize the noise levels during this period which do not otherwise unduly hinder the project
or unreasonably increase the costs of the project.

To Whom It May Concern:
Our home is at 994 Concordia Avenue near Chatsworth Street and we would like to D6ject to
the request for a noise variance to operate equipment to repair the Saint Peter-Rondo Storm
Tunnel20 hours per day from 5:00 am to 1:00 am, from January 8, 2007 to April30, 2007.
I work two jobs for 16 hours every day and my husband works his job for 10 hours every day.
I get five hours of sleep every night and f would like to get five hours of uninterrupted sleep.
The noise is already loud and bothersome and we would like to avoid further interruption of
our daily lives. We think that 20 hours per day is excessive and unnecessary.

Dear Office of LIEP,
Please accept ttris letter as objection to the request for a variance from the sound level
limitations by the City's Public Works Sewer UtiliTy. I received a post cazd indicting
Public Works would like to operate equipment 20 hours per day from 5:00 a.m. to 1:00
a.m., from January 8, 2007 to Apri130, 2007.
Currenfly the barricades and equipment aze set up approximately 40 feet from my front
door. I believe it to be absolutely unreasonable to operate equipment at the hours
proposed. Not only would the noise be a considerable problem, some of the equipment
has bright blinldng lights that beam directly in my windows when in operation. As an
altemative, I wouid be comfortable with tbe City operating its equipment from 7:00 a.m.
to 10:00 p.m.
