AND WHEREAS, this emergency arose by reason of the following facts and circumstances: (1) Necessary to do inspecting after day's work by contractor. THEREFORE, BE IT RESOLVED, that the proper city officers are hereby authorized to pay the employees who performed such work in accordance with the provisions of the Council's Salary Ordinance, Ordinance No. 6446. Inc. to rezone from "B" to "C" Residence property located on the north side of Cook Avenue and the south side of Magnolia Avenue between Arkwright and DeSota Streets which is described as Lots 27 tbru 33, and 13 thru 17, Windsor Square. On July 12, 1963, the Commissioner of Finance reported the petition sufficient with the owners of 22 of a possible 31 (70.96 %) tracts of land within the prescribed 100 foot radius having signed the petition. The subject property is vacant, having recently been filled, and consists of 7 platted lots having a combined frontage of 259 feet on the south side of Magnolia Avenue and 5 platted lots and part of a vacated alley fronting on the north side of Cook Avenue having a combined frontage of 190 feet. These twelve lots have an area of approximately 59,117 square feet, or 1.36 acres. To the east and adjoining and fronting on De Sota Street and Cook Avenue are single - family residences; to the north and across Magnolia Avenue is low, vacant land and St.Patrick's Church now underconstruction; west and adjoining is vacant land recent- ly classified "C" Residence, farther west and fronting on Arkwright Street is an 11 unit apartment building, a single - family residence and a two - family residence; south and across Cook Avenue is vacant land. A definite proposal for the development of this property has not been sub- mitted. The Board of Zoning considered this matter at their regular meeting on August 1, 1963, and it is the opinion of the Board that because of the soil condition this property would not be developed for single - family use, and the rezoning would be an extension of the "C" residence zoning to the west.
