1 WF3EREAS, Depar[ment of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng
3 and removal of a two story wood frame duplex with a one and one-half car gazage located on
4 property hereinafter referred to as the "Subject Property" and commonly laiown as 605
5 MAGNOLIA AVENUE EAST. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: WM
Specialty Mortgage LLC, 10790 Rancho Bernazdo Rd, San Diego, CA 9212-5705; George
Farkas/Remas Assoc., 480 W. Hwy 96, Suite 200, Shoreview, MN 55126; Countrywide Home
Loans, 400 Countrywide Way, Suite 30M, Simi Valley, MN 93065; Payne Phalen District 5
Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated August 1, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by August 31, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislarive
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsibie parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, November 13, 2007 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendarion to approve the request to order the

interested or responsible parties to make the Subject Property safe and not dehimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
altemarive by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within one-
hundred eighty (180) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 5, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 605 MAGNOLIA AVENUE EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this buiiding(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparirnent of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within one-
hundred eighty (180) days after the date of the Council Hearing.
2. If the above correcrive action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Properiy pursuant to tl�e provisions of Chapter AS of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
105 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested

The Department of Safety and Inspections has declazed this building(s) to constihzte a
"nuisance" as defined by Leb slative Code, Chapter 45. The Department of Safety and
Inspections has issued an order to the then lalown responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The pxoperty was re-inspected on September 5, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Department of Safety and
Inspections that_the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Deparhnent of Safety and Tnspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

The buildin� is a two-story, wood frame, duplex on a lot of 3,920 square feet.
According to our files, it has been a vacant building since May 22, 2006.
The current property owner is WM Specialty Mortgage LLC, per AMANDA and Ramsey county
property records.
There have been five (5) SI.JMMARY ABATEMENT NOTICES since 2006.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
The city has had to boazd this building to secure it from trespass.
On July 17, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BITILDING was posted on August 1, 2007 with a compliance date of
August 31, 2007. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $40,000 on the land and $60,000 on the
building.
As of December 20, 2006, a Code Compliance inspection has been completed.
As of November 12, 2007, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000 to $60,000. The
estimated cost to Demolish is $10,000 to $12,000.
DSI, Division of Code Enforcement Resolurion submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Rebuild or remove brick chimney.
2. Install guardraii and handrail in basement to code.
3. Rebuild entixe post and beam system in basement.
4. Rebuild window in bathtub azea on first floor. (Water lies in window sill)
5. Lower dead bolt on first floor unit front door and install closing device.
6. Install handrail on one side, inter-connecring on front stairs to second floar, with returns.
7. Replace door on rear of second floor unit.
8. Replace front step and handrail to code.
9. Repair or remove fence.
10. Install safety cables on garage O.H. door.
11. Insure basement cellar floor is even, is cleanable, and all holes are filled.
12. Install hand and guardrails on all stairways and steps as per attaahment.
13. Strap or support top of stair stringers, inside and outside.
14. Install plinth blocks under posts in basement.
15. Tuck Point interior/exterior foundation.
16. Install twenty minute fire-rated doors, with a self-closing device, between common areas and
individual units.
17. Install tempered glass in window over bathtub to Code.
18. Provide thumb type dead bolts for all enhy doors. Remove any surface bolts.
19. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
20. Provide comrolete storms and screens, and repair all door and window openings.
21. Repair walls and ceilings throughout, as necessary.
22. Re-level structure as much as is practical.

23. Any framing members that do not meet code (where wall and ceiling covering is removed,
members that are over-spanned, over-spaced not being carried properly, door and window
openings that aze not headered, etc.) are to be reconstructed as per code.
24. Provide general clean-up of premise.
25. Provide smoke detectars as per the Minnesota State Building Code.
26. Repair soffit, fascia trim, etc. as necessary.
27. Provide proper drainage around house to direct water away from foundafion and window
wells as needed.
28. Install downspouts and a complete gutter system.
29. Replace house and garage roof covering and vent to Code.
30. Provide general rehabilitation of garage.
ELECTRICAL
1. Ground service to water and repair.
2. Bond azound water meter.
3. Provide completed panel directory.
4. Insure a separate 20 amp laundry circuit and a separate 20 amp ldtchen appliance circuit.
5. Install "S" type fuse adaptors and "S" size fuses/listed breakers.
6. Insure proper fixses or breakers for all conductors.
7. Close knock-outs in service panel/junction boxes.
8. Properly strap cables and conduits in basernent(service conduit outside.
9. Install GFI receptacle in the second bathroom adjacent to sink.
10. Ground bathroom light in the second bathroom and disconnect receptacle.
11. Install globe type fixture on all closet lights.
12. Remove all cord wiring.
13. Repair or replace all broken, missing or loose fixhues, devices, covers and plates.
14. Check a11 3-wire outlets for proper polarity and ground.
15. Throughout building, install outlets and fixtures as per Bulletin 80-1.
16. Install smoke detectors as per Bulletin 80-1 and I.K.C.
17. Electrical work requires a Permit and inspections.
18. Insta111ights at front, side and back entry doors.
19. Remove or rewire all illegal, improper or hazardous wiring in garagelbasement.
20. Remove hazardous wiring between service panels.

PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
Basement
1. Temperature and pressure relief valve, dischazge piping, and gas venting are inconect.
2. Meter is removed and not in service and has conoded or incorrect piping.
3. Galvanized pipe before meter.
4. Boiler fill water line requires back-flow assembly or device.
5. Range gas shutoff and connector are incorrect on first and second floors.
6. Remove and cap a11 unused gas lines.
7. No heat in building. Repair all frozen, broken ar leaking pipe.
8. Bring up to code or remove and cap water closet and laundry tub.
9. Provide approved waste and vent in bathroom.
10. Bathtub faucet is broken and has missing parts.
HEATING
1. Recommend installing approved lever handle manual gas shutoff valve on gas appliances.
2. Clean and Orsat boiler bumer. Check all controls for proper operation. Submit report.
3. Replace boiler flue venting and pzovide proper pitch for gas appliance venting and tie
boiler and water heater venting into chimney liner.
4. Provide adequate clearance from flue vent pipe on furnace/boiler to combustible materials or
provide approved shielding according to Code.
5. Recommend adequate combustion air.
6. Provide support for gas lines to Code. Plug, cap and/or remove all disconnected gas lines.
7. Provide heat in every habitable room, bathrooms and first floor kitchen.
8. Attach metal tag to expansion tank valve staring that this valve must be OPEN at all times
except when draining the expansion tank.
9. Install boiler pressure relief valve and/or pipe boiler relief valve discharge to within 18" of
the floor. It is leaking.
10. Provide back-flow preventer on city water fill line to hot water/steam heating system.
11. Appropriate Mechanical Permits are required for this work.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
605 MAGNOLIA AVE E
and legally described as follows, to wit:
J. M. WARNER'S ADDITION TO ST. PAUL, MINN. LOT 17
to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On July 17, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
Thfis list of deFciencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, 5uite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspecrion and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the restricrions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such rime as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame duplex with a detached one and one-half car garage.
Exterior
1. The roof is deteriorated, defective, or in a state of disrepair. Repair ar
replace the roo£ covering to a sound, tight and water impervious
condition. Pemut may be required.
2. The exterior walls of the house andlor garage are defective. Repair all
holes, breaks, loose or rotting sading, to a professional state of
maintenance.
3. The stairs have missing or defective handraiis. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which aze grippable and installed 34" to 38" above the nose of the stair
treads.
4. There are missing or defective guardrails. Provide all stairways,
porches, decks or steps which are more than 30" high with guardrails
and intermediate rails with openings in the guardrail no mare than four
(4) inches apart and in accordance with the State Bnilding Code.
5. The eaves and soffits are in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
6. The windows and/or storm windows are in a state of disrepair. Replace

frames, sashes, hardware and associated trim in a professional manner.

The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.

chiiniiey to a professional state of maintenance and repair. Permit may
be required.
Note: The interior not inspected at time of this report but the following is a
Code Compliance Report prepared on December 20, 2006.
BUILDING
1. Rebuild or remove brick chimney.
2. Install guardrail and handrail in basement to code.
3. Rebuild entire post and beam system in basement.
4. Rebuild window in bathtub area on first floor. (Water lies in window
sill)
5. Lower dead bolt on first floor unit front door and install closing device.
6. Install handrail on one side, inter-connecting on front stairs to second
floor, with retums.
7. Replace door on rear of second floor unit.
8. Replace front step and handrail to code.
9. Repair or remove fence.
10. Install safety cables on garage O.H. door.
11. Insure basement cellar floor is even, is cleanable, and all holes are filled.
12. Install hand and guardrails on all stairways and steps as per attachment.
13. Strap or support top of stair stringers, inside and outside.
14. Install plinth blocks under posts in basement.
15. Tuck Point interior/exterior foundation.
16. Install twenty minute fire-rated doars, with a self-closing device,
between common areas and individual units.
17. Install tempered glass in window over bathtub to Code.
18. Provide thumb type dead bolts for all entry doars. Remove any surface
bolts.
19. Repair or replace any deteriorated window sash, broken glass, sash
holders, re-putty etc. as necessary.
20. Provide complete storms and screens, and repair all door and window
openings.
21. Repair walls and ceilings throughout, as necessary.
23. Any framing members that do not meet code (where wall and ceiling
covering is removed, members that are over-spanned, over-spaced, not
being carried properly, door and window openings that are not headered,
etc.) are to be reconstructed as per code.
24. Provide general clean-up of premise.
25. Provide smoke detectors as per the Minnesota State Building Code.
26. Repair soffit, fascia trim, etc. as necessary.

12. Remove all cord wiring.
13. Repair or replace all broken, missing or loose fixtures, devices, covers
and plates.
14. Check a113-wire outiets for proper polarity and ground.
15. Throughout building, install ouflets and fixtures as per Bulletin 80-1.
16. Install smoke detectors as per Bulletin 80-1 and LR.C.
17. Electrical work requires a Permit and inspections.
18. Install lights at front, side and back entry doors.
19. Remove or rewire all illegal, improper or hazardous wiring in
garagelbasement.
20. Remove hazardous wiring between service panels.
PLUMBING
All plumbing work requires pernut(s) and must be done by a plumbing
contractor licensed in Saint Pau1.
Basement:
1. Temperature and pressure relief valve, dischazge piping, and gas venting
aze incarrect.
2. Meter is removed and not in service and has corroded or incorrect
piping.
3. Galvanized pipe before meter.

discharge to within 18" of the floor. It is leaking.
10. Provide back-flow preventer on city water fill line to hot watexlsteam
heating system.
11. Appropriate Mechanical Permits are required for this work.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by August 31, 2007 the Department of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspecrion and Design Section, 8 Fourth Street, Suite #200, Commerce

The Enforcement Officer is required by law to post a placard on this property which
declazes it to be a"nuisance condition", sub}ect to demolition and removal by the City.
This placazd shall not be removed w7thout the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. 'I`he department is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify tt�e City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testnnony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement actian the Council may either order the City to take

4. Ordering the owner to remove or repair the building{s) at 605 Maenolia Avenue within
fifteen (15) days from adoption of resolution.
Mr. Magner stated the building was a two-story, wood-frame duplex dwelling on a lot of 3,420
squaze feet and had been vacant since May 22, 2006. A code compliance inspection had been done
on December 20, 2006 and the vacant building registrarion fees were current. The $5,000
performance bond had not been posted. On July 17, 2007, an inspection of the building was done
and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on August 1, 2007 with a compliance date of August 31, 2007. To
date, the property remained in a condition which comprised a nuisance as defined by the Legislative
Code. Ramsey County Ta�cation esrimated the mazket value of the land to be approximately
$4Q000 and the building to be $60,000. Real estate taaces were current. Code Enforcement
estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for
demolition was estimated to be approximately $10,000 to $12,000. There had also been five
smiunary abatements issued to this property since 2006, six of which went to work order: to secure
the building and the City had to board the building to secure it from trespass, remove improperly
stored refuse, and to cut tall grass and weeds. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner stated that it was his information that Mr. Eggers
had a purchase agreement or possibly had closed on the property as the property went to auction a
couple of weeks ago. Mr. Magner presented photographs of the property.
The property owner of record, WM Specialty Mortgage, did not appear. Daniel Eggers appeared
and stated that he was scheduled to close on the purchase of the property today, November 13. He
was awaiting the decision of the Legislative Hearing before he would go through with the closing,
however. He did have a letter from the bank indicating that he had the finances and would be
willing to post the bond by the following day. He explained that he did receive two estimates for
repairs; however, since he had not purchased it, he did not have access to the entire building. He
believed the building was salvageable and he had done this type of work in the past.
Ms. Moermond stated there were a couple of issues that she had concerning the report from staff.
Realizing that Mr. Eggers did not own the property, she had concern that the City had been
maintaining the property as there had been six work orders done at the property. She would
recommend that he be given additional time conditioned that he maintain the property. He would
also need to keep the building secured. She asked whether he understood that everything on the
code compliance inspection report needed to be repaired up to City Code. Mr. Eggers responded
that he understood that.
Ms. Moermond stated that she would require he present a wark plan, in accordance with the repairs
listed on the code compliance list. Mr. Eggers stated that he had prepared a rough draft outlining
the repairs that he would be making to the property. He explained that he would need to do the
plumbing first and would need to pull the permit which he believed they could do by the following
week. He then planned on repairing the roof as he would need to have the roof vented before the
roof could be replaced. The remainder would be generai contract work.
Ms. Moermond asked if he would prepare a more formal work plan outlining what he indicated he
was going to do. Mr. Eggers responded that he could get that to her by the following day.

Ms. Moermond stated that she would also require financial documentation outlining that he had the
financial wherewithal to complete the repairs. This could be in the form of a construction loan, a
line of credit.
Ms. Moermond stated that the following must be provided by the end of business on Friday,
November 30: 1) post the $5,000 performance bond; 2) the property must be maintained; 3)
provide a work plan; and 4) provade a letter from the bank indicating the financial wherewithal to
complete the rehabilitafion. If he did all of these things, she would recommend to the City Council
they g�ant him 180 days to complete the rehabilitation.
Mr. Magner asked Ms. Moermond whether she would also require a copy of the closing documents
be provided by November 30. Ms. Moermond stated she would also make that a part of her
conditions. Mr. Magner stated that the vacant building registration form would also need to be
filled out and filed with Code Enforcement.
