1 WF�REAS, Deparlment of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story wood frame duplex with a detached two and one-half car garage
4 located on property hereinafter refened to as the "Subject Properiy" and commonly known as
5 751 BiJRR. ST . This properiy is legaily described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property:
Mortgage Elec Reg Systems InciCo Hsbc, 636 Grand Regency Blvd, Brandon, FL 33510-3942;
MERS c/o Wells Fazgo Bank NA, 3476 Stateview Blvd, Fort Mill, SC 29715; Payne Phalen
District 5 Plannin Council.
WHEREAS, Depariment of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated August 1, 2007; and �
WHEREAS, this order informed the then known interested ar responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by August 31, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this buiiding(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Tnspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, November 13, 2007 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the
interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitaring this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the shucture in accordance with all applicable codes

(1� days after the date of the Council Hearing; and
WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 5, 2007 and the testimony and evidence inciuding the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE TT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 751 BURR ST .

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed mulriple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declazes it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The

rehabilitation or demolirion and removal of the siructure must be completed within
fifteen (1� days after the date of the Council Hearing.
2. If the above conective action is not completed within this period of tune Depazhnent of
Safety and Inspecrions is hereby authorized to take whatever steps aze necessary to
demolish and remove this shucture, fill the site and chazge the costs incurred against the
Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this tnne
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is fiu•ther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Departrnent of Safety and Inspections has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Department of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on September 7, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Depariment of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Department of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incuned against the real estate as a special assessment to be
collected in the same manner as ta�ces.

The building is a two-story, wood frame, duplex with a detached 2%2 stall garage on a lot of
4,792 square feet.
According to our files, it has been a vacant building since June 20, 2006.
The cwrent property owner is MERS c/o HSBC, per AMANDA and Ramsey county property
records.
There have been five (5) SiJMMARY ABATEMENT NOTICES since 2006.
There have been four (4) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On July 25, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO

6. Verify that fuse or circuit breaker amperage matches wire size.
7. Install GFCI receptacle first and second bathroom adjacent to the sink.
8. Ground bathroom light in basement/first/second/ bathroom and disconnect receptacie on fixture.
9. Install globe-type enclosed light fixture on all closet lights.
10. Remove all cord wiring.
11. Repair or replace all broken, missing or loose light fixtures, switches & ouflets, covers and piates.
12. Check a113-wire outlets for proper polarity and verify ground.
13. Through-out building, install outlets and light fixtures, as specified in Bulletin 80-1.
14. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other smoke
detectors as required by the IRC.
15. Install exterior lights at front and back entry doors.
16. Rewire hood fan in first floor kitchen.
17. Add a receptacle in first floor bedroom. (ARC fault)
All electrical work must be done by a licensed electrical contractor under an electrical'permit.
Any open walls, or wa11s that are opened as part of this proj ect, must be wired to the standards of the
2005 NEC.

This property is designated by the Vacant Buildings Deparhnent as a Category #3 which requires
a$5,000 Performance Bond or Deposit at the tune the permit is issued.
Most of the roof covering could not be inspected. All must meet appropriate codes when
completed.
There was considerable storage/clutter within property at the time of the inspection. Property is
to meet appropriate Codes when complete.
All items noted as recommended do not have to be completed for code compliance but should be
completed at a later date. Possible purchasers of property shall be made aware of these items.
This is a registered vacant building. In order to reoccapy the building, all deficiencies
listed on the code compliance report must be corrected and be in compliance with the
Minimum Housing Standards of the St. Paul Legislative Code (Chapter 34), and all

The Vacant/Nuisance Buildings Unit, Department of the Department of SaFety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and tegally described as follows, to wit:

to comprise a nuisance condition in violatfion of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On July 25, 2007, a Building Deficiency Inspection Report was compiled and ttze
following conditions were observed.
This list of de£iciencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Tnspection and Aesign Section, 8 Fonrth Street East, Suute 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condifion. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Tnspection and Design Office before any permits are issued, except for a
demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood &ame duplex with a detached, two and half stall garage.

replace the roof covering to a sound, tigl�t and water impervious
condition. Permit may be required.

all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
The chimney is defective, deteriarated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Permit may
be required.
4. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
The window andJor door screens are missing, defeclive or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
6. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardware and associated trim in a professional manner.
Permit may be required.
7. The steps are in disrepair. Repair/replace.
8. The exterior trim of the house has defective, peeled, flaked, scaled or
chalking paint or has unpainted wood surfaces. Scrape and repaint to
effect a sound condirion in a professional manner.
9. The garage is dilapidated and in need of general repair.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by August 31, 2007 the Departrnent of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.
As first remedial acfion, a Code Compiiance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard sha11 not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The deparfinent is further
required to file a copy of this "Order to Abate" with tke City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will norify the City Council that abatement action is necessazy. The City Clerk
will then schedule dates far Public Hearings before the City Council at which rime
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolurion calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code as�d
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

Ordering the owner to remove or repair the building(s) at 751 Burr Street within fifteen (15)
days from adoption of resolution.
Mr. Magner stated the building was a two-story, wood frame duplex with a detached two and one-
half sta11 garage on a lot of 4,792 square feet and had been vacant since 7une 20, 2006. A code
compliance inspection had been done on November 1, 200. The vacant building registration fees
were delinquent in the amount of $625 and the $5,000 performance bond had not been posted. On
July 25, 2007, an inspection of the building was done and a list of deficiencies which constitute a
nuisance condition was developed. An arder to abate a nuisance building was posted on August 1,
2007 with a compliance date of August 31, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation
estimated the mazket value of the land to be approximately $43,700 and the building to be $98,700.
Real estate talces were current. Code Enforcement estimates the cost to repair the building to be
approximately $40,000 to $50,000. The cost for demolition was estimated to be approximately
$10,000 to $12,000. There had also been five summary abatements issued to this property since
2006, four of which went to wark order: remove improperly stored refuse and cut tall grass and
weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
The property owner of record, MERS c/o HSBC, did not appear. Tom Sawyer appeared and stated
that he was the REO with ReMazc Resources, on behalf of the bank, Premier Asset Services. It was
the intention of the bank to sell the property "as is" for someone else to complete the rehabilitation.
He currently had a bid to purchase the property and was expecting to receive another bid today. He
stated that it was his intention to pay the vacant building fees today as well. He believed the bank
would review the bids and make a decision at the end of the week.
Ms. Moermond stated that Code Enfarcement estimates the cost of the repairs to be around $50,000
and she would require that whoever purchased the property would need to demonstrate that they had
that amount of funding dedicated to do the rehab to the property. She would also require a work
plan which would need to be drafted in conjunction with the code compliance inspection report.
They wouid also need to maintain the property. The vacant building registration form would also
need to be filled out. She asked Mr. Sawyer how long he had been the REO for the property.
Mr. Sawyer responded that he had been assigned the property in Januazy, 2007.
Ms. Moermond asked how many suminary abatement orders had been issued since January. Mr.
Magner responded that it appeared there had been one summary abatement order issued since
January which was done by the owner.
Ms. Moermond asked Mr. Sawyer whether this was a foreclosure situation. Mr. Sawyer responded
that it was a foreclosure.
Ms. Moermond recommended laying this matter over to the November 27 Legislative Hearing.
Leslie McMurray, District 5 Planning Council, appeared and stated that the district council had not
made a formal recommendation on this property. She did have a petition signed by 10 neighbors
expressing their desire to haue the building demolished.

Tom Sawyer, REO, appeared.
Ms. Moermond stated at the Legislative Hearing on November 13, Mr. Sawyer had indicated that
his client was reviewing bids that they had received and would make a decision by the end of that
week. She asked whether a decision had been made.
Mr. Sawyer stated that he expected to receive an e-mail from his client on a bid that they had
chosen to accept. Since he had not reviewed the bid, he was unsure how to proceed. He suggested
he be allowed to fas the bid to Ms. Moermond after he had a chance to review it with his client. He
claimed that the vacant building fees had been paid. His client also intended to put together a work
pian which he had not received yet either.
Ma Moermond stated that since this was scheduled to go befare the City Council on December 5,
she recommended continuing the hearing to December 4. She indicated that she would need to see
the work plan at that hearing.
Mr. Sawyer stated that he believed the bank was strongly considering doing the rehabilitation to the
property and then planned to sell the property at a low bid.
Mr. Magner asked whether the bond had been posted. Mr. Sawyer responded that it had not. Ms.
Moermond stated that he would need to post the bond before she could recommend to the City
Council that they grant additional time to rehabilitate the building.

Ms. Moermond stated that she was in receipt of a faxed letter, dated today, from Tom Sawyer
indicating that the mortgage company no longer desired to pursue repair of the building and they
would be obtauung bids to demolish the building.
Mr. Magner stated that Code Enforcement would like to see the building removed within 15 days.
He would agree to allow Mr. Sawyer to proceed with removing the building himself if he provided
proof that he had contracted with a licensed demolition contractor and that contractor would also
need to provide proof that they had obtained a demolition permit to remove the building.
Ms. Moermond recommended the demolition be stayed by Code Enforcement for 15 days to allow
the owner to provide proof of a licensed demolirion contract and a demolition permit. If the owner
fails to provide said proof, Code Enforcement will proceed with demolition of the building.
