The zoning is "C" residence. On June 1, 1963, the City Council granted an appeal to relax the density standards to permit an 11 unit apartment building with 12 off - street parking spaces to be erected on the subject property which then included the easterly 7 feet of Lot 25. As originally proposed, the subject property had a frontage of 85.8 feet and an area of appro- ximately 10,618 square feet, resulting in a deficiency of 382.square feet. In order to provide adequate sideyard, frontage and lot area for the residence adjoining to the west, it has become necessary to eliminate the easterly 7 feet of Lot 25 from the subject property which leaves the building site with a frontage of 78.92 feet and an area of approximately 9,714 square feet, or a deficiency of 1,286 square feet. The proposed building meets the building ground coverage standards and the off - street parking plan meets the standards for this type of facility. Field investigation discloses that while the original deficiency of approximately-800 square feet appeared to be realistic, the present request for a relaxation of 1,286 square feet is unreasonable and would be contrary to the purpose and intent of the Legislative Zoning Code. The staff and the Board of Zoning recommend that a 10 -unit apartment building be the maximum number of units for this site. In consideration of the above factors, the Board of Zoning recommends the denial of the appeal to relax the density standards to permit an 11 -unit apartment building on the above described property. Purpose of this appeal This project has been approved by the city council and a building permit issued. The actual construction has been started,and stoppdd by the building department because of an illegal devision of the land. In our previous application we included 7feet of lot 25, however this lot 25 was only 39.46 feet wide and since the division violates the city oddinance which says any lot under 40 feet cannot be devided,this division was illegal. The actual ground use remains the same the difference is that we cannot use the 7 feet for density requirements. We now have approximately4 11725 Sgj#re feet in the two platted lots. We respectfully submit thrht this land was purchased and construction started on the basis of the approval of the original application that we be allowed to continue the same building.
