WHEREAS, based upon the records in the Ramsey County Recorder's Office and
informarion obtained by Department of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: Sunny
Nyemah, 6830 Perry Ave N., Brooklyn Center, MN 55429; Resmae Mortgage Company,
6 Pointe Drive, Brea, CA 92821; District 9/West Seventh-Fort Road Federation,

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order idenfified as an"Order to
Abate Nuisance Building(s)" dated July 23, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by August 22, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this buiiding(s) to constitute a nuisance condition; subject to demolirion; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislarive
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, October 23, 2007 to heaz testimony and evidence, and after receiving
testnnony and evidence, made the recommendarion to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with a11 applicable codes and ordinances, or in the alternative by

demolishing and removing the structure in accordance with a11 applicable codes and ordinances.
The rehabilitation or demolifion of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 21, 2007 and the testimony and evidence including the action taken by the
Legislative Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 81 WESTERN AVE S.
That the Subject Property comprises a nuisance wndition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
buiiding(s).

That the deficiencies causing this nuisance condition have not been conected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in trus
resolurion and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested ar responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating tlus structure and correcting a11

accordance with all appiicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be compieted within
fifteen (15) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
sha11 be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code

The Department of Safety and Inspections has declared this building(s) to consritute a
"nuisance" as defined by Legislative Code, ChapTer 45. The Department of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on August 22, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Department of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Deparhnent of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

The building is a 1'/� story, wood frame, single family dwelling with a wood shed on a lot of 4792
square feet.
According to our files, it has been a vacant building since September 21, 2006.
The current property owner is Sunny Nyemah, per AMANDA and Ramsey County property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2006.
There have been four (4) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On June 28, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a
nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NLTISANCE BLJILDING was posted on July 23, 2007 with a compliance date of August 22, 2007. As
of this date this property remains in a condition which comprises a nuisance as defined by the
legislative code.
The Vacant Building registration fees are delinquent in the amount of $375.00.

On June 28, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily ail the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, S Fourth Street Easf, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Buiiding Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the reshictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a one and one-half story wood frame, single family dwelling, with a wood shed.
The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
2. The roof sagb ng by skylight — no permit found for this installation.
The chimney is defective, deteriorated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Permit may
be required.
4. The new vent in reaz roof for wood or gas fired appliance — no permit
found for this installation.
5. The siding is in contact with soil.
6. The dining room floor is buckled.
7. The interior second floor window is rotted and damaged.
8. There are damaged interior walls throughtout.
9. The flooding caused by burst water line(s)
10. The structure is a registered vacant building and must have a Code
Compliance Certificate before the structure may be occupied.
Immediately vacate the structure or obtain a Code Compliance
Certificate from L.I.E.P. You may contact Jim Seeger at L.I.E.P. for
code compliance inspection, pernuts, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code,
failure to obtain a Code Compliance Certificate or to vacate the
structure may result in issuance of criminal suminonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resuiting nuisance condition is not corrected by August 22, 2007 the Department of
Safety and Inspections, Division of Code Enfarcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subj ect to demolition and removal by the City.
This placard shall not be removed without the written authority of the Deparhnent of
Safety and Inspections, Division of Code Enforcement. The departrnent is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropri ate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if conective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Insure basement cellar floor is level, is cleanable, and all holes are filled.
2. Install hand and guardrails on a11 stairways and steps as per attachment.
3. Install plinth blocks under posts in basement as needed.
4. Tuck Point interior/exterior foundation.
5. Install floor covering in the bathroom and kitchen that is impervious to water.
6. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
7. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc.as necessary.
8. Provide complete storms and screens, and repair all door and window openings.
9. Repair walls and ceilings throughout, as necessary.
10. Provide fire block construction as necessary.
11. Re-level structure as much as is practical.
12. Where wa11 and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
13. Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
14. Any framing members that do not meet code (where wa11 and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
doar and window openings that are not headered, etc.) are to be reconstructed as per
code.
15. Provide general clean-up of premise.
16. Provide smoke detectors as per the Minnesota State Building Code.
17. Repair soffit, fascia trim, etc. as necessazy.
18. Provide proper drainage around house to direct water away from foundation. (house
has major moisture issues)

8. Ordering the owner to remove or repair the building(s) at 81 Western Avenue South within
fifteen (15) days from adoption ofresolution.
Mr. Magner stated the building was a one and one-half story, wood frame, single-fanuly dwelling with
a wood shed on a lot of 4,792 squaze feet and had been vacant since September 21, 2006. A code
compliance inspection had not been done, the vacant building registration fees were delinquent in the
amount of $375 and the $5,000 performance bond had not been posted. On June 28, 2007, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on July 23, 2007 with a compliance date
of August 22, 2007. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Rauisey County Tasation estimated the market value of the land to
be approximately $40,500 and the building to be $132,100. Real estate taxes for 2006 were delinquent
in the amount of $969.28, plus penalty and interest. Code Enforcement estimates the cost to repair the
building to be approximately $50,000 plus. The cost for demolition was estimated to be approximately
$8,500 to $10,000. There had also been four summary abatements issued to this property four of
which went to wark order: to secure the building and the City had to board the building to secure it
from trespass, remove improperly stored refuse, and cut tall grass and weeds. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs
of the property.
Ms. Moermond stated that the pictures were very telling, although there weren't any pictures of the
interior of the building. In reviewing the order to abate, it indicated that the roof was problematic,
there was sagging around the skylight which had been installed without a permit, the chimney was in
bad shape, there wasn't proper venting for the furnace, the floor was buckled, the windows were
rotting, damaged interior walls, and there was flooding caused by a burst interior water line due to the
property not being winterized.
Mr. Magner stated that flooding and the resulting water damage is generally problematic in that if it
isn't cleaned up prior to spring, there was usually mold growth. This would require the building to be
completely gutted and this couid not be identified until the code compliance inspection was completed.
The property owner of record, Sunny Nyemah, did not appeaz. Christina Weber, Wilford & Geske,
attomey representing Wilshire Credit Corporation, the servicer of the mortgage, appeared. Ms. Weber
stated that the code compliance inspection had been done on Monday, October 22. The property was
currently in foreclosure and would be going for sale in the near future. The mortgage company wanted
to look at the code compliance inspection to determine whether the property should be saved or
whether it should be demolished. She said that she had indicated to her client that if they did
determine that the property should be saved, they would be reducing the redemption period, paying the
taxes, paying the vacant building fees, paying the performance bond, and she informed them of what
other requiremeuts would need to be met.
Ms. Moermond recommended granring additional rime if the following is provided by the end of
business on Friday, November 16: 1) complete the vacant building registration form; 2) pay the vacant
building registration fees; 3) post the $5,000 performance bond; 4) pay the delinquent property tases;
5) provide a work plan with timelines outlining when the work would be completed; 6) provide a
financial plan indicating the wherewithal to make the repairs to the building; and 7) maintain the
property.
